Justice Clarence Thomas on Friday compared the leak of fellow Justice's Samuel Alito's draft opinion, which would overturn abortion protections under Roe v Wade, to 'infidelity.'

Thomas, 73, said that at a conference that the leak would weaken the public's trust in the Supreme Court as an institution, calling the unauthorized disclosure of deliberations 'tremendously bad.'

In his remarks, the conservative justice, who has long called for overturning Roe, hinted that a liberal clerk may have leaked Alito's draft opinion, and lamented that partisan rancor has grown more entrenched on the high court.

Thomas pondered: 'I wonder how long we're going to have these institutions at the rate we're undermining them, and then I wonder when they're gone or destabilized what we will have as a country and I don't think the prospects are good if we continue to lose them.'

He continued: 'When you lose that trust, especially in the institution that I'm in, it changes the institution fundamentally. You begin to look over your shoulder. It's like kind of an infidelity – that you can explain it but you can't undo it,' reports Politico.

Thomas, a nominee of President George H.W. Bush, said it was beyond 'anyone's imagination' before the May 2 leak of the opinion that even a line of a draft opinion would be released in advance, much less an entire draft that runs nearly 100 pages.

Thomas, who has long said he believes the Roe decision should be overturned, was speaking at the Old Parkland Conference, a meeting of black conservatives, in Dallas where he was Friday's keynote speaker.

Following his speech, Thomas sat for a questions and answers session with John Yoo of Berkeley Law School.

The leak just puts their nature on display for all to see.

I think many of us care who the leaker is. The liberal view seems to be, that they don’t care who the leaker is, because they are happy about any event which pushes the liberal cause.

I've been trying for DECADES to get the prolife side to use the DNA argument because the only argument against it is to say that DNA doesn't work.

Also trying to get all prolifers to use the term "preborn" instead of "unborn".

I've made virtually no progress.

I understand what you are getting at: rule by reason ALONE doesn’t work - you aiso need wisdom and a moral compass.

But even though reason alone is insufficient, it is still essential.

Reason is a framework - a language - without which there is no structure or accountability.

The trust is long gone. SCOTUS was shot when it hallucinated rights into existence, and produced all sorts of illogigal justification for preferred “empower the federal government” outcomes.

Congress has been a hapless, dysfunctional, unaccountable (other than to its comrades in SCOTUS) circus.

The executive with its multitude of unaccountable bureaucracies is the muscle of the criminal enterprise.

I like Thomas, but he’s wrong about this issue.

The problem that the Supreme Court is facing here is because they made a bad decision that doesn’t follow the Constitution.

Whenever the Supreme Court doesn’t follow the Constitution and bows to political pressure, or societal pressure, they erode the institution.

Confirming idiots to the Court, or allowing a clearly compromised Chief Justice to preside are also a problem.

This is how the left destroys institutions. They’ve done it time and again.

No, the court, if not populated by a critical mass of Constitutional Retards, especially the new one, can function just fine if it limits its work to the Constitution.

Of course they’d have to make all kinds of difficult rulings about government, the size and scope of government that would drastically change the welfare state. They could also save themselves a lot of trouble if they’d bother to make a ruling or two on the 10th Amendment.

No Justice Thomas, the problem is that the Justices of today don’t have the stomach for protecting our Constitution from a bureaucracy run amok for more than 150 years since the Civil War. THe new Roe ruling is a fix of a mistake the court made. There shouldn’t have even been a ruling to leak in this case.

I’m not going to have failth in the court just on account of it doesn;t leak. It could conduct deliberations in public, if it wanted to. The integrity of the court is a function of its output, which has been hallucinatory, uneven, and otherwise just another bunch of raw power in the hands of the feds.

Letting the states decide isn't a sure thing. California passed Proposition 187 in 1994 which would have established a state-run citizenship screening system and prohibit undocumented immigrants from using non-emergency health care, public education, and other services in the State of California.

Almost 60% of voters approved it.

Matthew Byrne issued a temporary restraining order against institution of the measure, which was filed by State Attorney General Dan Lungren. After Judge Mariana Pfaelzer issued a permanent injunction of Proposition 187 in December 1994, blocking all provisions except those dealing with higher education and false documents...

Well, ICIG Atkinson and that weasel Vindman decided leaking is okay of executive communications, internal workings, and the country had an impeachment with no consequence to the illegal leak. ICIG has no jurisdiction over the WH. His jurisdiction is the IC.

I agree with RFEngineer above - the institutional integrity is shot because of its decisions, not because of infrequent leaks. The leaks are an internal problem, they can police themselves or not, and it won’t affect the integrity of the output. The reason courts like to hid deliberations is because deliberations are less about the law and more about the outcome.
