I have no suggestions as to what would be a better replacement for our current jury system, but if Smollett is acquitted it will only be because of the demographics of the jury.
In the bad old days of Jim Crow, it was a frequent criticism that an all-white jury was unlikely to convict a white man who committed a crime against a black man. I think that problem has been largely fixed.
But (at least since OJ) if a black man is on trial, and there is a black person on the jury, then the trial proceedings may not matter all that much. The jury just might be steered to acquit because White Supremacy.
