Some of you may recall that a couple of years ago when Gorsuch and Kavanagh were going through their confirmations, and when Trump was having "short lists" and nominating appellate court judges, I had a source on the court system whom I referred to as Zen Master to keep his identity secret.
He is well placed, but more important, has uncanny instincts and does his research. In a six-year period, he never missed a call. He would alert me to who would be on the USSC short list, who the appellate appointees would be, and how the character of the court was shifting.
He even could predicte WHEN specific nominees would be confirmed, and he assured me way ahead of time that both G and K would be confirmed. With K, he missed the confirmation date by a week---because Balless Edsel dropped her charge at the last minute.
He's been quiet for a while, but with the vax mandates & the Dobbs abortion case we began to discuss things.
*He thinks the 6th Circuit will uphold the ban on vax requirements by the 5th, and that any appeal will not be heard by the USSC, ending the vax mandates. *He thinks the Dobbs ruling will be 6-3, with Roberts joining K & ACB to overturn Roe. *I asked if Roberts would try to weasel out with a "compromise." He said he may try, but can't. Any variation from "viability" would itself represent a new moving target and create bigger headaches. *I asked if he thought Roberts could bully/persuade K or ACB to going to the left with him. He said flat no. *My inference: Roberts will not be on the losing side on this. So when he sees that ACB and K are not moving, he will adjust accordingly. *BTW, I asked if it was true that the justices HAVE ALREADY VOTED on this, and he said yes. The tradition is the day after oral arguments, they take a straw vote on the case. Now, he said on occasion people switch their votes between the straw vote and the final written decision. Roberts himself did this on one of the earlier abortion cases. But it's highly unusual. Justices do not normally "buttonhole" other justices and try to persuade them. *He was "cautiously optimistic" the court will rule correctly here.
I miss you on Twitter but I understand. Twitter is such a sewer.
“Roberts will not be on the losing side”
That’s the key.
He’ll vote the winning side. Does not want to be seen on this as The Loser.
And even worse with the new guy, is how I see it.
Nice to see you. I quit twit a long time ago. Far more downside than up.
In order to become a Zen Master, you must be able to answer a Zen koan.
Here is the one I had:
“What is the sound of one hand clapping?”
My answer:
“Whiff whiff whiff”
I am like a Black Belt in Zen.
He views the decision primarily in terms of institutional legitimacy: a 6:3 vote appears much more convincing than 5:4.
The good news is that they're making themselves irrelevant.
Really, @jackboot? Putting a warning on information from the American Heart Association?
Did ZM ever say why SCOTUS refused to get involved in the election fraud/treason?
Is it possible those sources are right who say Trump was screwed by his own legal team (mainly Rudy & the WH Counsel), and that the evidence of election fraud was never actually brought to court, or at least not to SCOTUS ... presumably because some of those the President trusted the most were compromised?
The stench of the 2020 election is not going away for a long, long time.
All of this is pretty much the informed opinion. Doesn't take a secret source.
Because there was never a compelling legal argument made. His own team (Rudy, et al) were nibbling around the edges looking for 4,000 here, 6,000 there. The outsiders (who really got in the way, like Powell and Wood, were charging a grand conspiracy with absolutely no evidence-—as seen by the fact they have now been held liable for legal fees to the opposition in those cases.
There was no cohesive 14th Amendment argument by the official legal team; and there was no cohesive national conspiracy evidence by the outside team.
I have a substack daily column under Larry Schweikart.
I am on: @OtherWalls
A little more to it than that. Further discussions with Zen Master:
if Roberts is on the winning side, he as CJ writes the opinion.
if he is on the losing side vs. K, ACB, Gorsuch, Thomas and Alito . . .
CLARENCE THOMAS writes the decision. Roberts absolutely would not want Thomas writing this decision. Now, some, including a longtime Freeper whom I haven’t asked permission to use his name here, think that Roberts could “limit the damage” if he writes this. Zen Master disagrees, saying overturning Roe IS the “damage” from the leftist point of view, and besides there is no way to compromise the “viability” issue-—and any attempt to finesse that would probably create brand new issues the court would still have to rule on.
It makes sense to me that Roberts is in a box and MUST vote to overturn Roe.
*bump*
Will add you to my Substack subscriptions. Currently I donate to Glenn Greenwald and Techno Fog.
I think the Democrats WANT Roe to be overturned, in order to outrage and energize their base.
Otherwise they are in trouble in 2022 and 24.
I think the game plan is to tell their base: ok, with Roe gone, abortion is up to state control, so we need to win lots of states.

OK, we’re calling the whole thing off then, can’t have that.
That would be a mistkae.
1) Congressional races don’t connect to Supreme Court issues because there’s no role for them.
2) There’s only a handful of DemoKKKrat senators in trouble, and it may help a few of them, but not people like Mark Kelly here in AZ. Other issues are more important.
3) It will balance out by the absolute ecstatic right turnout who will support Rs (many of whom have done nothing on the issue).
4) This is a red wave election. Not much will change that unless John F. Kennedy replaces Biteme in the next year.
Great. Thanks.
