U.S. District Judge Kathleen Williams granted Norwegian Cruise Line Holdings a preliminary injunction on Sunday evening challenging Gov. Ron DeSantis' statewide ban for businesses to require vaccines before engaging in certain activities. In the ruling, she wrote that Florida failed to "provide a valid evidentiary, factual, or legal predicate" for the ban, documents obtained by Politico show.
The order allows the company to operate with 100% vaccinations or the requirement of all guests and crew to be vaccinated when sailing from Florida ports. The company will not be subject to $5,000 fines for every violation of the Republican governor's order, which imposed the ban on vaccine passports on July 1.
The ruling comes roughly two weeks after Royal Caribbean International reported in late July that a cruise departed from Nassau, Bahamas, with six guests aboard who tested positive for COVID-19, four vaccinated and two unvaccinated aboard.
Peter Patterson, who represents the Sunshine State and Florida's Surgeon General Scott Rivkees, hinted during a court hearing on Friday over the injunction that Florida may attempt to take the case to the U.S. Supreme Court. Florida's attorney general has also asked the Supreme Court to block the Centers for Disease Control and Prevention's protocols requiring 95% of cruise ship passengers and 98% of crew be vaccinated, among other CDC measures he argues are keeping the industry from fully reopening.
NCL will be able to sail under its own safety terms and conditions for the time being under the preliminary injunction.
The Washington Examiner contacted the governor's office and the Florida Department of Health but did not immediately receive a response.

Well, what are ya gonna do? Judges write the laws and that’s that. I don’t know why we bother with other branches of government at all. They seem so ... unnecessary.

I heard the other day a Carnival cruise ship ALL passengers and crew fully vaxxed and it STILL had a covid breakout.
It was another Obama judge. If Florida appeals it will likely be reversed since 85% of rulings by Obama judges that are appealed get reversed.
They are trying to debunk that so everyone can fall into one of two categories -vaccinated and unvaccinated. -Tom

They sailed with 6 covid-positive passengers??? And 2/3 of them were vaxed! So what’s the point, NCL? Delta doesn’t care if you are vaxed or not. So you’re just a floating incubator if you allow positive passengers aboard. That seems a tip able.
If you want to go on a cruise then get the Fauci Ouchi as well.
No one holds a gun nor a law saying you have to take a cruise with Norwegian Cruise Line.
It is their cruise line, and they can do whatever they want re passengers/customers as long as it isn’t racist or sexist.
They didn't depart that way. They tested positive on the sixth day of the seven-day cruise.
The Carnival Vista had a similar situation last week, although Carnival is not releasing the number of people involved.

Everyone should already be boycotting these oreign owned and foreign flag cruise lines anyway. Now there’s just one more reason to do so.

Having had both the virus and the jabs this year,, just saying 6 months sounds good ain’t good enough. It’s 300 days out to the next cruise.
It would be nice if the CDC or NIH or WHO had some definitive studies available, maybe they do, or don’t want to release them.

I expect Carnival will make first day lifeboat drill easier and a few other things easier so the passengers are more at ease.
Certain hospitals ashore will have outpatients or visitors go through as many procedures as some Cruise Lines just to be let in the Hospital.

"DeSantis spokeswoman Christina Pushaw said Monday that the administration disagrees with the ruling and will take the case to the 11th U.S. Circuit Court of Appeals."
No boat drills...just watch a video in your cabin and then go at leisure to your muster statin to watch a demonstration of the lifejacket and to get your card swiped...
