A federal judge tossed out a lawsuit from more than 100 hospital employees who sued Houston Methodist over its policy requiring all staff to be vaccinated against COVID-19.
The workers alleged in their lawsuit that the hospital was "forcing its employees to be human 'guinea pigs' as a condition for continued employment." They also accused the hospital of violating the Nuremberg Code of 1947, likening the vaccine mandate to Nazi medical experimentation on concentration camp prisoners.
US District Judge Lynn Hughes was not sympathetic to either argument, writing in his order of dismissal Saturday evening that none of the employees were forced or coerced to take the vaccine. He also noted that the hospital cannot violate the Nuremberg Code because it is a private employer, not a government.
"Equating the injection requirement to medical experimentation in concentration camps is reprehensible," Hughes wrote. "Nazi doctors conducted medical experiments on victims that caused pain, mutilation, permanent disability, and in many cases, death."
He added that the workers were free to accept or reject a vaccine and that they would "simply need to work elsewhere" if they chose the latter.
"If a worker refuses an assignment, changed office, earlier start time, or other directive, he may be properly fired. Every employment includes limits on the worker's behavior in exchange for his remuneration," Hughes wrote. "That is all part of the bargain."

Nope. Was never tempted to go into medicine.
You don’t like the working conditions? Leave. I spent time in the military where quitting wasn’t an option and I was sent places where people shot at me. But I made the choice to join. I accepted the terms.
He is not a moron; he is corrupt, based on personal experience.
I'll point out that Hughes, who turns 80 in September, is STILL a sitting judge on the Southern District of Texas.
Most federal Article III judges take senior status in their sixties, with some holding out till their early seventies, opening up a seat for the sitting president to fill.
This judgehole puke could have taken senior status any time during Trump's presidency and locked up another conservative seat for 20-30 years.
He's not on our team.
“ Lying through your foul teeth troll boi.
A drug test, involves peeing in a cup, and subsequent instrumental analysis of the urine.
That’s utterly different from requiring injection of an untested substance……
——————————————————————————————
Well, good morning to you too.
Nothing like starting off your comment with the now typical anti-vaxxer name calling.
I was subjected to random drug test. How is that a lie?
The whole context was pointing out that Employers do have some say over our bodies.
In fact I never even mentioned the Covid vaccines.
A little touchy are we?
I had to take other vaccinations too. How is that a lie?
Most of the conversation was about what an Employer can require from an employee with regard to appearance, and of course Health issues.
Untested substance?
Tell me, how many millions of people need to get vaccinated before a vaccine is considered tested?
Most States are now at 60% or better of their population vaccinated.
170 million people are vaccinated.
You don’t suppose data and vital information has been gathered from that many people?
This vaccine has had the LARGEST Human trial in history.
Sorry to ruin your Sunday butter cup.
No one should compare Texas and Florida; two different animals.
TEXAS: huge, manufacturer, technology innovation and processing, world presence, oil & gas giant, law firms of national and international scale (some law firms nastier than Hillary Rotten and her demons), politically volatile with Democrats threatening to take control at every turn.
FLORIDA: big but populated by many retirees, strongest legal protections for private property in the country, politically more stable, red state firm foundation, Democrats control Miami, Broward but little else, very strong Cuban-American Conservative faction.
Abbott has more constraints than DeSantis, they should not be compared.
Abbott must maneuver more to help his party faction continue to hold power because he has Rove-Bush like elements (e.g. Carlyle Group) that are globalists in character and who dance with globalist Democrats.
DeSantis is a rising star indeed but he’s got it easier in FL.
Put DeSantis in TX and it wouldn’t be so easy. He might tap dance more than Abbott.
Put Abbott in FL and Abbott could breathe easier.
THEY SHOULD NOT BE COMPARED BECAUSE THEIR POWER BASE INFRASTRUCTURE IS DIFFERENT.
Like all laws these days, HIPAA was designed to protect the powerful medical (and other) interests, not you and I.
MD Anderson Cancer Center doesn’t require any of the employees to get a COVID-19 vaccine. It would be hard to find a medical facility that has more at risk patients.
You have very much against anyone who states that the hydroxychloriquine cocktail is very effective in the treatment of Covid.
So what is your opinion now that the CDC and NIH now admit that the hydroxychloriquine cocktail and other similar drugs do work.
How many hundreds of thousands of people have died for the political and financial benefits of Democrats and Big Pharma?
So you're doubling down on your despicable practice, by lying in a different direction, to detract from your original lie, that EUA jabs are allowable because p*ssing in a cup is allowable.
You are such an utterly dishonest shill: one fundamentally changes your body, leading to severe medical side effects, one does not.
The military doesn’t require service members to get vaccinated.
40-50% of the employees at the CDC and NIH have refused to be vaccinated.
You are not very intelligent, or very honest.
From three year old boys on up, people know that soldiers get shot at.
It is NOT clear that one of the requirements for a medical job is to be subjected to experimental gene therapy in response to a falsely-decreed “EMERGENCEEEEE!” to benefit BigPharma and Dr. Mengele-types like Fauci (called out small children for being carriers of AIDS, funded experiments grafting scalps of aborted children onto mice, funded weaponization of viruses in Wuhan *that’s what “gain-of-function” is a eumphemism for)), following the development of a foreign bioweapon imported/spread to our shores from overseas, with the connivance of top Dem Party officials.
“There is no “coercion” involved. You CHOOSE to take a job. You CHOOSE to quit. No one forces you to work a given job. If you have the right to quit, then what you decide is WHAT YOU DECIDE!”
That’s some authentic frontier gibberish right there.
First thing, not that it should matter, but I’d point out in this instance they already have the job.
Right now they are being pressured to take an experimental vaccine or else they will get fired.
You know damn well that’s coercion. What’s important to understand here, is apparently you think that’s OK.
It is illegal under federal law to require anyone to take part in clinical trials, accept an experimental drug or vaccine, and it is illegal to use coercion as a means of compliance.
Is it your contention that employers can “choose” to break federal law here?
Almost like when they wrote these laws they anticipated this exact sort of abuse. Almost. Weird, huh?
You don’t like the working conditions? Leave. I spent time in the military where quitting wasn’t an option and I was sent places where people shot at me. But I made the choice to join. I accepted the terms.
Thank you for your service.
It’s different for private company healthcare workers, though.
I guess the govt/military could just take these hospital systems over and enforce experimental shot requirements, in the same way.
That will likely improve the morale and effectiveness of the staff.
🙃
Sounds like socialized healthcare. The best/cream of the crop will leave.
In post #66 I use Hooter Girls as an example.
What exactly do those precious young ladies have to do with a vaccine?
You clearly are having some issues.
Try to gain control, you’ll feel better.
Your life and the life of many others around here have become All Vaccines All the Time.
An obsession.
Have your party invites dropped off yet?
Is it your contention that the Covid-19 vaccines are not experimental, and authorized only under emergency use?
We’ll all “learn more” by your answer here, I’m thinkin’.
Good try, though!
Agree about the differing constraints, between TX and FL, but, not about abilities of DeSantis (if he were in TX).
;-)
Well perhaps I might have been but it wasn't intentional. On the obverse side of this is that your post struck me as being rather dismissive of what I had posted. So perhaps I might have been a touch perturbed. However, I did not direct anything in derogatory terms towards you but rather tried to present evidence that my post was factual, and my opinion was not based simply out of thin air, but was the result of what I had garnered from actual people who knew what they were talking about.
Now I want to present to you this video , which is 3+ hours long, so I in no way expect you to listen to it all of it, as even I have not done so. It is posted on the board, but the title would not compel you to click on it, as I still am not sure what made me click on it to be quite honest. 8>)
Anyway, this is a video about the adverse affects people are experiencing from these so=called "vaccines", and why I disagree with this judge's decision. I recommend that you at least listen to the first 30 minutes of this video:
How to save the world, in three easy steps.
See what I mean by the title being a really bad choice? 8>)
“forcing individuals to violate their personal health”
Utterly dishonest of you! Never in any way said people should be FORCED to get a vaccine. No one MAKES you work somewhere - unlike when I was in the military and had no choice about getting anthrax shots.
I will be surprised if MD Andersen does not require it in the near future. It will probably be required on a CMS level not the individual institution. As for hydroxychloroquine it does not work in the hospitalized patient. Early on I gave it to almost every hospitalized patient as did my colleagues. As the evidence bears out it was less than impressive. I’m sorry if that doesn’t fit with your agenda
so far you can still work without the covid vaccine in a hospital. Those days are likely numbered
