Shayla Sowell had been with her son Shamari Anderson inside the Fulton Street Station on Dec. 11, 2019, when the tot slipped away from her and lost his footing as a northbound 2 train was approaching.

The operator "should have known" that the Mother and child were near the edge of the platform??????
No guard rails?
I hate to see the death of a child, but it was mother’s fault for not holding the kid firmly.
All she sees now is JACKPOT!!! Ding, ding, ding!!
Mom fault/guilt transference, trying to validate by lawsuit payout.
2yr old hyperactive tot should have had a child safety harness on. I rode the subways in NYC in 70s & 80s, and never saw a guardrail. Most stay near the walls, 15-20ft from the tracks, so a crazy doesn’t shove someone on to the tracks.
“tot slipped away from her and lost his footing as a northbound”
How does a 2 year “slip” away from mom?
Concur.
Obviously the driver’s fault for swerving off the tracks and driving down the platform.
Wait, that isn’t what happened? You mean he stayed on the track and she was either negligently or intentionally responsible for the death of a child and is looking to turn it into a payday?
I kept a leash on my toddler daughter when we were in public to make sure I had control and she wouldn’t slip away. My wife was initially indianite that I’d treat my daughter like a dog, but we never got separated.
This apparently wasn't a child.
It was a tot, presumably a potato tot.
the tot slipped away from her
Mind your tots.
Deep pockets?
Court should throw this out immediately. A judge should refuse to hear it.
Drive up to Hotlanta some weekend. and ride the subway. Since it sounds like you've never seen one.
You might want to wear a kevlar jacket for the trip. Check the website for track replacement closures. If you come up 85 just go to the Airport. If you come in on 20, go to the Hamilton D. Holmes station just off the Ralph David Abernathy Freeway.
I used a wrist leash when we traveled overseas. I fastened it to my wrist, and had her hold the loose end. It was her job to make sure I didn’t get lost, or so I told her. She did a great job, which I also told her.
My wife didn't like it either, but the leash stayed on the kid any time we were in a crowded place.
I never had a problem on MARTA, but it’s been a few years. Things may have changed.
Might as well sue the electric company too.
Agreed. She is responsible, but the MTA has deep pockets, so....
Exactly. Grew up in Chicago and took the el all the time. You have to stay away from the edges.
Why wasn’t Mom holding his hand? Tightly?
Little ones can be unpredictable. When my son was four, we were shopping at Sears
He thought it would be hysterical to hide from me in one of those clothes carousels.
I suddenly couldn’t see him and started screaming his name; people even came over to me.
Then I heard a giggle and saw a rustle of clothes... Opened up the clothing carousel and voila! LOL!
That's not what SHE said but we all know she lies.
