While I have great sympathy for any parent that loses a child, especially in the horrific way this child died, how is this the MTA's fault?

The operator "should have known" that the Mother and child were near the edge of the platform??????

I hate to see the death of a child, but it was mother’s fault for not holding the kid firmly.

All she sees now is JACKPOT!!! Ding, ding, ding!!

Mom fault/guilt transference, trying to validate by lawsuit payout.

2yr old hyperactive tot should have had a child safety harness on. I rode the subways in NYC in 70s & 80s, and never saw a guardrail. Most stay near the walls, 15-20ft from the tracks, so a crazy doesn’t shove someone on to the tracks.

“tot slipped away from her and lost his footing as a northbound”

How does a 2 year “slip” away from mom?

Obviously the driver’s fault for swerving off the tracks and driving down the platform.

Wait, that isn’t what happened? You mean he stayed on the track and she was either negligently or intentionally responsible for the death of a child and is looking to turn it into a payday?

I kept a leash on my toddler daughter when we were in public to make sure I had control and she wouldn’t slip away. My wife was initially indianite that I’d treat my daughter like a dog, but we never got separated.

This apparently wasn't a child.

It was a tot, presumably a potato tot.

the tot slipped away from her

Mind your tots.

Court should throw this out immediately. A judge should refuse to hear it.

Living near the rail yards in KS City, KS. You become very aware that RR vehicles DO NOT stop on a dime and do not give change. They seem to go forever and ever when stopping and they weigh in at thousands of pounds.

Another negligent "mother" trying to project the blame for her child's death on someone else===>she smells a Big Payday.

At least this poor black child won’t have to face being shot to death by a racist cop or grow up in an America that is apparently filled to the brim with white supremacists. /s

Since when do NYC subways have conductors? Not for years.

How about her case is dismissed as frivolous and she is then indicted for negligent manslaughter(or equivalent).

The Train Operator will have to live with this experience the rest of his Life.

He should be suing the Idiotic Mother.

One more reason why these cities are doomed as their infrastructure falls farther and farther behind standards from decades ago.

You can find photos and videos from train stations like those in Tokyo where the train platforms are completely guarded from the open pits where the tracks lie. The train pulls in and the large steel and plexiglass doors between the platform and the train open at the same time the doors on the train open. You walk through both sets of doors to get inside the train.

New York City, running on 1800s infrastructure, doesn't have the room to install such standard equipment.
