Is Kamala Harris eligible to be Joe Biden's VP?

Is Kamala Harris a natural born citizen?

It is no secret that Harris wants to be Joe Biden's vice president. The junior senator from California clearly sees an opening to her real objective: the presidency of the United States. With Biden surprisingly outlasting the other anti-American socialist candidates, Harris recognizes that Biden's age and declining cognitive abilities pose a glorious opportunity to resurrect her presidential ambitions. After all, there is an good chance that the bumbling, incoherent Biden might have to resign or be removed in his first term and his V.P. would succeed him. Even if Biden managed to miraculously finish his first term, it is unlikely that he would or could run for a second.

Harris would love to "back door" her way into the presidency, especially given the fact that her vacuous campaign was an unmitigated disaster, and any future presidential ambitions looked to be a virtual impossibility only a few months ago.

But not so fast. Harris is constitutionally ineligible to be VPOTUS (12th Amendment) or POTUS (Article 2). She is not — nor can she ever be — a natural born citizen, the highest standard of citizenship mandated by the Constitution for the president and commander-in-chief. The Founding Fathers wanted a higher standard of citizenship for the POTUS because they did not want any competing allegiances with foreign governments.

Harris was born in Oakland, California on October 20, 1964, to an Indian citizen mother and a Jamaican citizen father. Thus, Harris is a native-born American citizen, or a citizen pursuant to what I refer to as the anchor baby provision of the 14th Amendment. ... continue reading at: https://www.americanthinker.com/blog/2020/08/is_kamala_harris_eligible_to_be_joe_bidens_vp.html

Give a Democrat a chance to piss on the Constitution and they’ll never pass it up.

And quite a few Republicans, Jindal, Rubio, Cruz, Haley, George P. Bush and their fans.

So you then agree with the reverse - If a person, because of the conditions of their birth DOES NOT NEED TO BE NATURALIZED, they are defacto, natural born citizens.

Thank you for making my point

There are only two types of citizens under current US law.

1) Those citizens that due to the conditions of their birth and recognized by US law section 1401 are citizens at birth

and

2) Those citizens that due to their actions and US laws are citizens by natualization.

Period - no other category of naturalization exists. I was born here in the US to US citizen parents and according to US law, sectiojn 1401 subsection a, I am a citizen at birth and do not need to be naturalized.

to wit - Title 8 section 1401 subsection a reads:
(a)a person born in the United States, and subject to the jurisdiction thereof;

We have a bunch of deliberately obtuse posters who will argue against the simple clear language of the Constitution until they are blue in the face.
They want the office of President opened to citizens of the world, the exact opposite of the founders intent.

One can only naturally be a citizen of the USA when one cannot be a citizen of any other country.
Born here of citizen parents.

Her mother & father divorced when she was a child. Mother moved to Canada and it is unknown if she became a Canadian citizen. Eventually, her father became an American citizen, but her mother did not.

Neither of her parents were citizens of US. Both had student visas.

That horse already escaped. Obama was, under those criteria, CLEARLY not eligible, because his father was - without any dissent from anyone - a British subject when he was born.

The birthplace issue was a complete distraction - and it worked, everyone was focused on the name of the hospital and the layering of his birth certificate, and NONE OF THAT MATTERED, only the nationality of BOTH of his parents. Now watch: if she’s the VP pick, the EXACT same kind of distracting arguments will be made, with exactly no focus on where it should be - the nationalities and thus the loyalties of her parents when she was born.

If the voters of this country not only buy this crap, but also buy the lies of the Democrats and knowingly vote for someone who has dementia, then our country DESERVES to die. I hope that people wake up, but the indoctrination of our intellectual class that started in the 1930s has tragically borne poisonous fruit over the last several decades.

Doesn’t matter where she was born - it matters what nationality BOTH of her parents had.

You can be a citizen at birth without also being a “natural born citizen.” The term “natural born” is purposely and distinctly different from the term “citizen,” and it is that way for a reason. It can ONLY be presumed that every single word in the Constitution (or any law, for that matter) is there for a specific reason - they cannot be ignored because they are inconvenient to a particular person or cause. “Natural born” means something...and among the things that it means is that Kamala Harris should never be eligible to be President or Vice President of the US.

Oh, I get it. Yea, the precedent that was set is scary. Of course, I have never been a fan of precedent over ruling that which we know is correct.

“Wouldn’t be much good on the campaign trail.”

But he also wouldn’t make all of the gaffes that Biden has been making.

It’s worse than that.

Its this: Born in a U.S. state regardless of parentage (Kamala H., Barack O., Bobby J., Nikki H., Marco R., Anwar al A., Chester A. (1800’s), Charles Evan H. (1900’s)), OR born overseas or in a non-state U.S. territory to at least one U.S. citizen (John M., Ted/Rafael C., Winston C., Barry G., George R.).

We are supposed to believe that by Natural Born Citizen, the framers of the U.S. Constitution meant: every human being other than those born overseas to alien parents.

"Harris was born in Oakland, California"

There you go. There's plenty of good reasons not pick or to vote for Kamala Harris. But she's certainly legally eligible for the office.

Low hanging fruit. Just too easy for me. Any one else care to take a crack at it?

“We are supposed to believe that by Natural Born Citizen, the framers of the U.S. Constitution meant: every human being other than those born overseas to alien parents.”

Which is ludicrous right? Yet we have many, right here of FR, that are making exactly that case.

I have yet to have any of them, make a case as to why natural born citizen was invoked, if citizen at birth was the same.
