The Michigan legislature is suing Gov. Gretchen Whitmer for unilaterally extending Michigan’s coronavirus state of emergency, House Speaker Lee Chatfield, R-Levering, and Senate Majority Leader Mike Shirkey, R-Clark Lake, announced in a Wednesday, May 6 news conference.
The lawsuit is going to the Michigan Court of Claims with hopes for an expedited ruling, Chatfield said. The House and Senate declined to extend the state of emergency last week, but Whitmer later announced it would be extended from April 30 through May 28 – citing a 1945 law allowing her to do so.
The 1945 Emergency Powers of Governor Act allows governors to call for a state of emergency for as long as necessary, while the 1976 Emergency Management Act limits it to 28 days, but doesn’t invalidate the prior law.
Whitmer’s interpretation of the 1945 law is unconstitutional, Chatfield said.
“The law in Michigan is very clear: Only the legislature has the authority to extend a state of emergency,” Chatfield said after removing his American flag face covering to speak. “We chose not to do that last week because we were given no real assurances of any substantial changes that would be made, and the administration’s refusal to sit down and work together.”

It sounds like she has correctly interpreted the 1945 law. But if the 1976 law limited the time period she can declare an emergency without legislative approval then she is being lawless.

But the reality is, not everyone in America has a job with health care and benefits. In fact, many have jobs that don’t even pay enough to cover their monthly expenses.
It doesn’t matter what the president says about the stock market. What matters is that millions of people struggle to get by or don’t have enough money at the end of the month after paying for: transportation, student loans, or prescription drugs.
American workers are hurting. In my own state. Our neighbors in Wisconsin. And Ohio. And Pennsylvania. All over the country. Wages have stagnated, while CEO pay has skyrocketed.
So when the President says the economy is strong, my question is: strong for whom?
Strong for the wealthy? Who are reaping the rewards from tax cuts they don’t need?
The American economy needs to be a different kind of strong.
Strong for the science teacher spending her own money to buy supplies for her classroom.
Strong for the single mom picking up extra hours so she can afford her daughter’s soccer cleats.
Strong for the small business owner who has to make payroll at the end of the month.
Michigan invented the middle class. So, we know - if the economy doesn’t work for working people, it just doesn’t work.
Who fights for hardworking Americans? Democrats do.

Can anyone tell me why any Governor would have emergency powers that extended beyond the time required for the legislature to meet and vote on their own course of action. It makes no sense that it would be any other way.

Not trying to defend half whitmer, but this needs to be cleared up by the courts...1976 potheads only passed half of a law.... failed to revoke the old one...
I don't think it works that way. If an old law says the punishment for jaywalking is 30 days in jail and the new law says the punishment is 10 days in jail, then the effect of the new law is to nullify the old one despite the lack of specific language to do so.
There certainly could be a scenario where the first law had greater scope than the new one. This limitation on a governor's ability to extend an emergency doesn't appear to be that.
