New Jersey Shuts Down Drive Through Tulip Farm, Threatens to Arrest Owner

CREAM RIDGE, NJ – Governor Phil Murphy’s administration today shut down the drive-through tulip farm in Cream Ridge, but allowed the owners to continue selling their tulips to their customers for curbside pickup.

Owner Casey Jansen said his family owned farm makes about a one million dollar annual investment into planting tulips to operate the annual drive-through. This week, he was relayed a message from Attorney General Gurbir Grewal, “No drive through allowed”.

“We planted all these tulip bulbs in the months of October and November. That’s when we make the investment, and my investment is just about a million dollars,” Jansen said in an interview with NJ.com.

Meanwhile, out in Gloucester County, the Dalton Farms tulip drive-through, which is booked solid through the weekend has given a pass by Murphy’s administration.

Jansen claims that he received a letter from the state threatening that two New Jersey State Police officers would be at his farm to arrest him if a single car drove through his field.

Because of the new curbside pickup policy, reroute traffic so that the only exit is a drive through the tulips.

No charge for the drive, but there is a $20 surcharge for all purchases.

Won’t the owner likely sue and win big bucks, as the Gov’s edict has no legal defense. He spends big bucks planting these tulips annually.

Yes but, who knew until experts told us that tulips can be infected with coronavirus? Or maybe it's the other way around: tulips are infectious and need tulip-sized flower masks but none are available--obviously Trump's fault. At any rate, we now know why drive-throughs are dangerous---to someone or something. (sarcasm)

I am sure a lot of this also just has to do with who has the governors, state legislators and federal or state authorities ears. If you’re a big corporation that donates politically to EITHER party, if you employ thousands and have lobbyists, a team of lawyers on your permanent payroll like Lowes or Home Depot, then somehow magically you provide essential goods and services and get to stay open, but if you’re Juan’s tacaria selling taco’s in Dallas, you’re up the creek because the folks making the rules don’t really take into account what you want or need. They say they do, but they don’t.

Those with the right connections get to shape the rules and this entire corona virus scare truly highlighted this fact. This went without notice also by the MSM which tomorrow will run some race baiting story (when it fits into their narrative in some attack) but ignore that small and minority owned businesses were especially hard hit while the large and well connected corporations not only got to stay open, they even get bail out money.

The corona virus scare really just turned into rules based on some good sounding idea (not empirical data driving decision making) and who you know.

Hopefully he recovers multiple millions in his lawsuit against the state. I would let care in and sue for wrongful arrest as well

This is Fascism, how can you intentionally destroy a person’s business like this, where is the relief under the law for this? Almost like invoking Eminent Domain and then not paying for the property.

When are the people of NJ going to rise up?

Potentially a couple forms of relief. One is exactly what you describe: treating it as if the state invoked eminent domain and then didn't pay for the property. It is called the "regulatory takings" doctrine, or sometimes "inverse condemnation." The doctrine is somewhat complicated, but the gist is that if government regulation deprives property of economic value and is of such a character that it could be "characterized as a physical invasion," then the property owner is entitled to compensation just as if the property was taken through eminent domain.

There will probably be a lot of litigation over whether and to what extent that doctrine applies to coronavirus lockdown orders. I am looking at taking some of these cases myself, but I recognize that it could be risky because I will probably be taking them on a contingent fee and there will be a lot of political pressure on judges hearing these cases.

Another form of relief would be to seek an injunction preventing the government from enforcing the regulation because it is unconstitutional. There would be a number of different arguments, but basically the gist would be that some legally-protected right is invaded such that the regulation is subject to "intermediate scrutiny" or even "strict scrutiny" under the Supreme Court's substantive due process jurisprudence. If "strict scrutiny" applies, then the government regulation is presumed unconstitutional and only holds up if the government can show the regulation is necessary and narrowly tailored to achieve a "compelling government interest." If you can find an argument for strict scrutiny, then a lot of these coronavirus orders should fail because they are plainly overbroad, although political pressure on the judges will again come into play.
