Judge approves unusual court transportation plan for defendant who weighs more than 900 pounds

A man who weighs more than 900 pounds is set to be brought to federal court in Richmond on Monday, after the approval of a plan involving the FBI, the U.S. Marshals Service, the Richmond Ambulance Authority, the Henrico County Division of Fire, and state and local emergency personnel.

Kenneth T. Hicks, 48, of Emporia, who is charged in a cocaine conspiracy case, is scheduled to plead guilty before U.S. Magistrate Judge David J. Novak and could be taken into custody immediately. On Tuesday, Novak approved an unusual transportation plan for Hicks sought by the government and his lawyer in an effort to protect his health, safety and dignity.

The arrangements could involve cutting through a wall where he lives, bracing the structure and even cutting down some trees.

Court papers show that the alleged conspiracy to distribute and possess with the intent to distribute more than a pound of cocaine took place from 2013 into 2017.

At least three of the seven people charged in the conspiracy have pleaded guilty. Hicks, who has not been in custody, was allowed to make an initial court appearance via video link on March 21. He asked authorities for help to get him to the federal courthouse on East Broad Street in Richmond for Monday’s hearing.

A joint agreement by the government and the defense filed this week asked Novak to approve the transportation plan to get Hicks from his residence — he lives in a dwelling attached to the rear of a mobile home — to the loading dock of the courthouse for the hearing.

Years ago, I owned and restored a very rare 1968 Ford Mustang T-5 (German export). A month after the restoration was completed it was stolen. We recovered it two years later - the mastermind of the operation weighed well over 600#. He hired Cuban Marielitos to do his street work. He was convicted of multiple counts but skipped out of incarceration - the jail could not accommodate people of that size.

Take him to a secure medical facility after he pleads guilty? How about just keeping him on house arrest and save the expense of treating him at the expense of what will bee hundreds of thousands of dollars. He’s not going anywhere.

Given his condition and the often serious efforts the Bureau of Prisons makes to assure the health of its prisoners (see Orange is the New Black), this might be the best chance he's ever had to recover and eventually lead a vaguely normal life. Given the cramped nature of prison living, they're probably going to have to make some serious physical modifications in any quarters where they plan to keep him.

They would be liable if he was wounded or killed during transport.

I am assuming he is not very mobile. And it is not like officers can just cuff and drag him in.

Regardless of exact medical diagnoses. He is handicapped.

If he was an athlete who lost his legs and arms bungee jumping he would still require special accommodations.

I am guessing he doesn’t want to be fat and probably tried to lose weight. To reach that high of weight a lot of things must be going on medically and mentally.
