The federal courts have shut down our ENTIRE government
Conservative Review ^ | 12/27/2018 | Daniel Horowitz

Posted on 12/28/2018 9:28:56 AM PST by Rusty0604

Amid the imbroglio over a partial furloughing of nonessential workers in a handful of federal departments, the political class has ignored that the government has already been shut down – in full and permanently. Individual district judges now control our national sovereignty, border policy, and every other political question. And now Chief Justice John Roberts has essentially barred the doors of the Supreme Court shut to any judicial redress of this judicial crisis

One district judge said that children must be released. Then another one said parents must be released with the children. Then a district judge in D.C. said the definition of asylum must be expanded to Obama’s policy, beyond an individual fear of persecution. Now a district judge is being allowed to sustain a ruling that Trump can’t even request that they come to the points of entry

In once again allowing the lower courts to reign freely, Roberts is not only perpetuating the shutdown of our border but the shutdown of the Supreme Court itself. What is the purpose of the Supreme Court if it only encroaches on the powers of the other branches but won’t police its own inferior courts when they violate all legal norms? Let’s review the unprecedented insanity of this case:

1) Four left-wing advocacy groups were given standing to sue on behalf of caravans that are literally not even in our country simply because they asserted that their institutions must expend more resources educating their clients on the new policy. It would be equivalent to Conservative Review obtaining standing because we have to expend more resources explaining the new policies we don’t like to our readers. This is perhaps the most absurd violation of Article III standing in recent memory, yet Roberts allows it to continue

America has an absolutely massive and politicized government, full of many thousands of competing interests. Its become a hairball of complexity and politics.

It has grown and survives only on massive spending and massive debt in our printed, unbacked currency and manipulated interest rates.

This situation can’t continue forever.

With Kennedy as swing vote, Roberts was content to side with the conservatives in decisions where his vote didn’t matter.

Now that HE is the swing vote, expect him to vote with the left on every issue important to the left.

It would be congress job to fix this by making immigration law. I think this is exactly what they want.

Hopefully Trump will get to replace RBG soon. Of course she may continue to vote from home in her freezer.

The article is right on point.

It is imperative that Trump take one more step and close the border - not just until partial funding is in place for the Wall - but until our present immigration laws and policies are corrected.

Today we have the absurd fact that our government is actually facilitating the economic invasion (including communicable disease and terrorist elements) by being required to transport invaders to the middle of some of our cities.

The open border crowd has got to be rolling on the floor in laughter.

It really is that simple, but seems to be impossible politically.

Congress could have fixed this pretty easily by amending the Judiciary Act, and should have done so before the Democrats take over. They could have removed a district court’s jurisdiction to enter injunctions against the federal government effective outside its own district. Or they could have vested exclusive original jurisdiction for claims for injunctive relief against the federal government in one court, to avoid forum shopping.

For some reason, neither party has any interest in fixing this problem.

Problem is, when they shut down the border, it’s just the ports, the illegals can still walk across unsecured areas and then the stupid laws force us to keep them. Closing the ports may incentive Mexico to do more. But the news is Honduras is forming a 15,000 caravan to invade Mexico.

Is the state governments still operating?

Well then..the GD federal government can go..

Other than national defense, foreign relations, making commerce regular among the states, etc, the federal government isnt needed.

And the first two are under the control of the POTUS nearly exclusively-other than the funding. And the funding for those are to come from EXCISE taxes, NOT direct income taxes.

All these lands-BLM, Parks, US Forest Service lands, are constitutionally illegal.

The laws are already there, but some judges and justices are blatantly ignoring and dismissing them.

More laws won’t help if they aren’t or won’t be enforced.

The problem is this - the left cares more about having open borders than we on the right care about having them closed. They are activist fighters we are passive voters, if we can even be bothered to do that.

It goes both ways.

In the case of Trump's asylum proclamation he wants to override the law that explicitly says migrants can apply for asylum even if not at a port of entry.
