Congress could have fixed this pretty easily by amending the Judiciary Act, and should have done so before the Democrats take over. They could have removed a district court’s jurisdiction to enter injunctions against the federal government effective outside its own district. Or they could have vested exclusive original jurisdiction for claims for injunctive relief against the federal government in one court, to avoid forum shopping.

For some reason, neither party has any interest in fixing this problem.

Justice Thomas talked about doing that very thing through SCOTUS. I don’t know if he discussed this with other justices or if somebody needs to file a suit. I’m here in Texas and I would love to file suit against the ninth circuit activist judge that is causing tens of thousands to pour across our border.
