A Long Island man is suing CVS after a pharmacist allegedly blabbed about his use of an erectile-dysfunction drug to his wife.
The New York Post reports Michael Feinberg had a prescription for Viagra that he would pay for himself and worked for it not to go through his insurance.
When Feinbergs wife called the pharmacy chains Merrick store to get word on one of her own prescriptions she had filed, the employee opened up about her husbands secret, the Post reported, citing the lawsuit.
Feinberg claims the pharmacy chain violated his privacy under the Health Insurance Portability and Accountability Act. Now that word has leaked to his wife, Feinberg told the Post that his marriage is breaking down.
He is seeking unspecified damages for negligence.
A spokesman for CVS told the Post the chain has the highest priority on protecting the privacy of those we serve.
Yeah, but the pharmacy committed a real boneheaded move. They might get the shaft. They should have used their head, because this is nuts.
“Another poster nailed it... Maybe he wasnt using the Viagra with her.”
The only way she could know that, is if she wasn’t holding up her marital responsibilities.

If I was into litigiousness I’d probably do it too, even if it wasn’t a secret. It’s a HIPAA violation, keep your mouth shut. We giggle about this in our household, the prescriptions service the wife uses leaves messages all the time, but they’re so incredibly vague even she has no idea what they’re talking about. She even filled out the form allowing detailed messages, but their autodialer doesn’t seem to have any non-vaguebook scripts.

It’s almost refreshing to see that kind of Pollyanna innocence still living on in today’s world.
It’s like you can’t even imagine a psycho woman so immature that she cannot realize his ED is likely a physical issue, and not turn it into “if you loved me it would work right”, and “you don’t find me attractive”, or a million other psycho things.
Use a different pharmacy!
If he had only used that excuse.
The wife knows now. So does the girlfriend.

This reminds me of a lawsuit someone filed against the doctor who performed an implant surgery on him of the kind that gives new meaning to “pump it up”. The guy sued when the doctor started using the guy’s name in promotional information. Not only did he lose because he didn’t read the fine print that gave the doctor permission to use his name, it was a slow news day and the local rag ran a front page above the fold story on it, so everyone knows about his inflatable manhood.
They’re desperate to the point of insanity. I love tapdancing. :)
It takes real talent to do that, but seems like largely a lost thing.

It’s actually a very clever, albeit unethical, scam if the husband and wife are working together.
