Judge overturns life without parole sentence for DC sniper Lee Boyd Malvo

WASHINGTON - A federal district court judge has overturned the sentence of Lee Boyd Malvo, one of the two people convicted in D.C.-area Beltway sniper attacks nearly 15 years ago, according to a ruling released Friday.

Malvo was sentenced to life in prison without parole for the sniper-style attacks committed around the region in October 2002 along with John Allen Muhammad. Ten people were killed and three others were shot during a three-week period.

Malvo appealed to the court saying he should not have been sentenced to life without parole because he was 17 years old at the time of the murders and he based his appeal on the Supreme Court ruling in Miller v. Alabama.

The individual states where this occurred need to immediately file various lesser state charges not included in the original conviction like failure to yield on a left-turn while in the commission of a felony, then re-arrest him. Completely of of the judge’s jurisdiction.

Resentencing.....25 years for each count...just working the system...stirring the muck...job security for judges and lawyers...

Ever since there has been a Justice system in the USA, and ever since the have been Courts of Appeal, everyone convicted of a crime by a jury has been entitled to a full round of Appeals, all the way up to SCOTUS, if they take the case. Although not criminal matters, we got the Heller and McDonald decisions on winning Appeals.
Although it has flaws, the US judicial system is the best in the world.

This story was just on one of those ‘crime’ shows this morning! I cannot believe this!

The TERROR those two put everyone through in the DC/MD/VA area, let alone those they gunned down in cold blood? That b@stard should rot!

Here’s hoping justice is SERVED beyond prison. You can bet cash money that this kid became 100% radicalized in prison. We’ve not heard the last of him.

"John Allen Muhammad was executed by lethal injection on November 10, 2009, at 9:06 p.m. EST at the Greensville Correctional Center near Jarratt, Virginia, and was pronounced dead at 9:11 p.m. EST.[4] Muhammad declined to make a final statement.[5]

There are multiple murder and violet crime charges outstanding in other venues.

Do NOT treat this travesty as a get-out-of-jail (Hickenlooper Syndrome).

Put the rascal on trial in a state court and treat him as an adult.

Yeah, maybe. Or it could be accepting the rule of law.

Miller v Alabama is pretty clear that imprisonment without chance of parole for juveniles isn't constitutional.

The Judge who sentenced him to begin with, is the one who should be responsible for this mess. He never should have allowed for the murder convictions to be served concurrently.
