Singer Barbra Streisand, a major Hillary Clinton supporter and one of Hollywood’s most outspoken leftist activists, is calling on President Obama to bypass Congress and unilaterally appoint his pick for the U.S. Supreme Court.
The Senate declined to hold hearings or votes on Judge Merrick Garland’s nomination as part of its broad “advice and consent” power. Obama nominated Garland in March to replace the late Justice Antonin Scalia.
Now that Donald Trump has won the election and is set to nominate a judge, Streisand has circulated a petition urging Obama to quickly appoint Garland to the court before Trump can be sworn in as president...

By the Constitution, Obama can make a recess appointment. That appointment is effective until the end of the next Congressional session.
There is no definition of a Congressional session in the Constitution, but that is left up to Congress to decide, the word session appearing only 3 times.
Therefore, if Obama abuses the recess appointment, Congress can respond by beginning in 2017 announcing a session lasting until the day after Trump’s inauguration, a one day recess, and then a new session.
Any recess appointment being good only until the beginning of the next session of Congress.
Hardball can be played by both sides.

It was disturbing to discover that the local sheriff, a Democrat, chose which laws to enforce and which not to. I also had discussions with the state’s attorney’s office, also Democrats, and they called it “prosecutorial discretion.” They were quite open about it. The law is the law if they say it is. I suspect it operates that way all the way to the top.
The information in the present context being the Constitution.

I remember reading that Ruth Bader Ginsberg was not actually first on the list for the Clintons.
Top of the list was Stephen Breyer (who of course would be appointed later, following Ginsberg). He was favored by Ted Kennedy or some other powerful NE Dem pol.
The story was, Bill Clinton met with Breyer for lunch and took an immediate dislike to him. Breyer was pompous and condescending. Ginsberg apparently less so. Ergo, Ginsberg got picked first.
