Issa: FBI "Has No Choice"; Must Indict Clinton

The FBI "really has no choice" but to recommend an indictment against former Secretary of State Hillary Clinton, according to former House Oversight Committee Chairman Darrell Issa (R-Calif., shown). His statement echoes Tom DeLay's claim last week that the FBI is "ready to indict."

While much of the focus has been on the fact that Clinton passed classified information over an unsecured server, Issa pointed out that, as bad as that is, there is more to it:

These are documents that are not only highly classified, but she took them from government. Let's not forget when she left government, she didn't leave a copy. She took it all. So, it's taking and holding classified documents.

Yes. Sandy Berger not only stole national security documents (original docs with hand-written notes in the margins) ... he took the stolen documents to his home and SHREDDED them.

Remember how our corrupt media dismissed the crime as mere "sloppiness" on Berger's part?

Not defeatism. Merely accepting the reality that prosecutions occur or don”t occcur based on the politics. Charging some schmoe has little political risk. Charging Her Thighness is a huge political risk. Like finding a horse’s head under your covers kind of risk.

Heroic prosecutors that go up against the powers that be are a hollywood myth.

We The People outnumber our agents. We create the political force. Defeatists should stay quiet and not spread their weakness and weaken our aggregate force.

You are right.

I don’t get all the defeatism.

Sometimes I think it’s just people who do it because they think that will magically cause things to go the other way. Sort of like wearing lucky socks when your team is playing on tv.

Other times I think it is people who just want to complain in the hope that someone in authority will see their anguish and do the right thing to relieve their anguish.

And then I realize that they are just defeatist assholes doing the Democrat’s dirty work.

With approved locks.

In an approved facility.

The Clinton crime syndicate has gotten away with everything until now including, I believe, the murder of Vince Foster. All past history suggests they will skate once again, however, for some reason the nature of how the email scandal is playing out tells me that maybe the “worm has turned” and the Clintons will finally get what is coming to them. I sure hope so. A cell in Leavenworth is fitting place for the Clinton trash to spend the rest of their days.

At the least Clinton has violated:

18 USC § 793
18 USC § 798
18 USC § 1924
18 USC § 2071
36 CFR § 1236.22

Let’s look at the first one: 18 USC § 793(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—Shall be fined under this title or imprisoned not more than ten years, or both.

Lynch must indict. Fed. R. Crim. P. 7(a)(1)(B) An offense (other than criminal contempt) must be prosecuted by an indictment if it is punishable by imprisonment for more than one year.
