Wallace agreed to a plea agreement in which charges were reduced to criminal attempted manslaughter and illegal discharge of a firearm, instead of the initial four charges of attempted first-degree murder.

Two thieves, one shot and FOUR first-degree murder charges. Must be some new math???

What I don’t like is he can’t own a gun. So, now it is out there that an elderly gentleman is alone in his house unarmed. Perhaps he can “borrow” a gun. He wouldn’t “own” it. It sounds like this poor guy has been set up for some sort of violent act and he is not allowed to protect himself. Just a thought

One of the suspects, 28-year-old Alvaro Cardona-De Lorea, was shot through the eye, leaving him with brain damage and a disfigured skull. Cardona has undergone a competency evaluation which showed he may not be competent to stand trial. His case has been continued. <<
The DA suffers from brain damage for dragging an honest citizen through court for defending his property when the government chooses to look the other way at illegal immigrants (who I often have nothing against if they are just working).

Yet, Torres-Ochoa was arrested again in 2008 for felony larceny in Adams County.

Agricultural trespass plea deals became a hot issue in the 2006 governor’s race, when it was revealed that the Denver district attorney’s office, under future Gov. Bill Ritter, repeatedly allowed people charged with serious drug or violent crimes to plead guilty to farm land trespass.

Like Ritter’s office, other county district attorneys at the time used the agricultural trespass charge because undocumented immigrants were likely to plead guilty to the lesser crime to avoid deportation.

A 2006 Colorado law required law enforcement officers to report an arrested individual to U.S. Immigration and Customs Enforcement if they have “probable cause” to think the person is in the country illegally.

In Denver alone, Cardona-De Lorea was cited six times for driving without a license, four times for driving without insurance and three times for driving without valid license plates between March 1999 and July 2005, according to court records.””

The guy fired at the thieves as they were pulling away on a city street. He was in the wrong.

However, no way he merited attempted murder charges. I think the outcome is fair enough...what he did violated the law where he lives, and this isn’t a huge punishment.

Since the source is The Denver Post and The Post is circulated only in the Denver area not outside in adjacent states. So I aasume this happened in Colorado. Am I correct ?. Just where in Colorado is Jefferson county that this DA could be so protective of illegal aliens ? Was this DA elected to office or appointed ?

His mistake was most likely talking to the police without an attorney.

A competent attorney would tell him to say NOTHING, but at trial (if it ever got that far, because if he didn't talk, they probably wouldn't have charged him) give a good story about how when you told them to STOP stealing your property, they came at you in a threatening manner.

Please remember to NEVER talk to the police, the more you talk, the more rope you are handing them to hang you.
