Tiger Woods’ Wife Elin 'Wants Half His Fortune' as She Prepares to Meet Divorce Lawyers
The Daily Mirror (UK) ^ | 12/16/09 | Ryan Parry

Tiger Woods’ devastated wife has called in California’s top celebrity divorce lawyer, say her friends.

And Elin Nordegren – rocked by her husband’s string of alleged affairs – could get half the £337.5million he has earned in the five years they have been married.

The 29-year-old Swedish model, seen out in Florida yesterday minus her wedding ring, is believed to be meeting celebrity lawyer Sorrell Trope next week.

Trope, 82, a partner in Californian law firm Trope and Trope, has represented big-name stars including Cary Grant, Nicole Kidman, Nicolas Cage and Britney Spears in a 60-year career.

And in another blow to Woods, Elin is believed to be planning to file for divorce in California – where the couple have a home – and not Florida, where they live.

Under California law the “no-fault divorce”, introduced in 1970, means there is an equal division of assets and property.

This could mean that any pre-nup agreement Elin signed with the golf star will be torn up.

A source said: “Mr Trope is the best divorce lawyer in the business and the divorce laws in California are much more favourable than most other states.

“Elin can fight for half of what her husband has earned since they were married. And Trope can bust through any pre-nup – he’s done it many times before.”

Last night, when asked if he was representing Woods’ wife as her divorce lawyer, Trope replied: “Not right now.”

Friends say Elin will spend Christmas in Orlando with the couple’s children, daughter Sam Alexis, two, and son Charlie Axel, 10 months, before filing for divorce in the New Year.

"I don’t like the law and I think in general divorce and family law is biased against men, due in large part because the development of the law in this area in the last few decades has been driven by radical feminist judges, legislators and lawyers."

Which is precisely why I laugh every time I hear Alec Baldwin bitch and moan about the state of America's family courts and surround law. It's because of his ilk that the courts are in the mess that they're in today.

I spent two-plus decades as a Navy JAG, I could regale you with stories about sailors coming home from a cruise and finding their old lady shacked up with another man. They, because of their demanding work life, get screwed in court. They almost never get custody, even when the mother is a deadbeat drunk (which is not infrequent). And, the mother frequently leaves town to move back to her home, or her new boyfriend's home, leaving the sailor, who's not making a lot of money to begin with, isolated in debt and out of touch with his children. It's a pathetic story that is oft repeated.

It is a fantasy to pretend that Elin and Tiger contribued equally to the marriage in respect of acquiring marital assets. The 50/50 rule is bad law in the case of one spouse with a vastly greater role in acquiring the marital assets.

Multiple adulterous affairs doesn’t indicate, at least to me, a responsible parent. A responsible parent is on who does his best to provide for his family and is monogamous and true to his marriage vows. And it wouldn’t matter to me whether it was she or he, same rules apply.

How is she going to get CA venue? I’ll bet their have driver’s licenses from here (Florida), listed addresses here on their 1040s, vote here (if she can vote), etc. His four major corporations are all FL corps, etc.

In fact, I’m sure they are domiciled here. Florida constitutionally prohibits a state income tax. In CA, it’s huge.

Unless CA will let her venue shop, it’s an Orange County, Florida case.

Thanks for your service. We could use some good JAGs these days. It seems they handed out commissions to quite a few far left wackos in order to fill the ranks of counsel to the Gitmo detainees.

"Its not a "winner take all" situation with the kids and the Courts should find ways to keep both parents included in their childern's lives."

The is a large divide between what a court should do, and what it will do. It depends on the jurisdiction, but in divorces absent civility, a court is reluctant to order joint physical and legal custody (especially legal custody, which requires frequent and earnest communication between parents). On balance, such an arrangement in an unfriendly divorce would be infrequent.

Marriage is a partnership—don’t you get that?

Marriage is a partnership—don’t you get that?

For Tiger, it was a PR prop.

"How is she going to get CA venue?"

This is exactly why this article is FOS. She would have to move there and establish residency, which is unlikely. If she tried to exit the state (or country, which is a possibility here), Tiger could (and would if something wasn't negotiated) file a TRO, demanding that she at least return the children.

Elin is endanger from going from a very sympathetic figure to being a gold digger. This is a terrible PR move.

It took this long for you to realize she's not a sympathetic figure? Women who marry rich men after they make it big should never be sympathetic figures, given that they have what I'll call a high gold digger quotient. Now, if she had been his high school sweetheart and supported him financially through many ups and downs, that would be a different story.

Tiger knows how the game is played - on the course and off... rules and laws are part of any game.

Excellent summary of this whole sad situation.

Marriage is a partnership—don’t you get that?

With 50% divorce rates and so many marriages lasting just a few years (like Tiger's) it's become more like a transaction than a partnership for a substantial percentage of people.

I hate commenting on the speculative gossip but in this instance why would she deserve half?

I feel badly for the kids. Tiger’s lost my support. But that doesn’t mean I’m suddenly sympathetic to a former nanny who had the opportunity to marry a rich man and took it. How do I know if her reasons for doing so were moral or whether they were cynical.

Some money to live comfrtably which in their world may number in millions. Money for the children. Not half of his estate though. She didn’t do a thing to earn half.

Now I wish they’d just stop these stories because I’m sick of hearing about it. I could have gone a lifetime without hearing all the sordid details that have come to light.

Why do men not say “hell hath no fury like man scorned” when they kill a woman?

Instead you reserve it for a woman who was publicly cheated on. Not by “oither women’, but by prostitutes, escorts, porn stars and whores.

I read somewhere that Tiger’s dad used to keep him in line and that everyone involved in pro golf knew how Tiger really is.

In fact, I’m sure they are domiciled here. Florida constitutionally prohibits a state income tax. In CA, it’s huge.

If she has the records and potential testimony to make even an arguable case of CA domicile, it's a big negotiating chip to throw on the table and force Tiger into a favorable settlement. CA revenue authorities must be licking their lips at the prospect of taking a big slice of Tiger's fortune for back taxes. I could see the divorce getting settled out of court in FL with a side agreement in which she agrees to fully support FL domicile for tax purposes.

Marriage is not just the sum of it's accrued assets the law does not care about the acquiring of the assets when it divides them, nor should it. It's about the equal contribution to the marriage, which is a unique institution with it's own history that predates both law and governments that make laws.

The law wisely chooses to not quantify the non-monetary value a wife brings to the marriage, it absolutely does not want to get into the business of putting a value on getting and bringing forth of legitimate children.

The article is BS. Pre-nup agreements are alive and well in CA and have been for years. If Tiger has any smarts, he will file for divorce in FL. Just because they have a residence in CA is no reason she has a right to file here. Even if he waits and she files in CA, he should then file in FL and contest the CA filing.

"I’m suddenly sympathetic to a former nanny who had the opportunity to marry a rich man and took it."

Wait a minute. It's not like she was a nanny without opportunity. She comes from a well-to-do family herself. Her dad is successful, and her mother is a well-known politician in Sweden. She, and her sister, were acting as nannies during their "gap year" - a year many Europeans take-off between high school and college.

She was going to, and might have, attend college and make a career as a child psychologist. She spurned Tiger for some time before finally relenting to go out with him. And, that was only after her "boss", Jesper Parnevik, intervened on Tiger's behalf and suggested that she should go out with him. Parnevik explained just last week that this is the reason he said he was so disappointed in Woods - because he personally vouched for his character.
