Obama eligibility case will be heard on the merits !! Please distribute everywhere.
At the hearing today at the Federal Court building in Santa Ana, Judge Carter reportedly said the following: 1. There will be a trial. 2. It will be heard on the merits. 3. Nothing will be dismissed on proceedural issues. 4. The trial will be expeditious, and the judge pledged to give case priority. 5. Being a former Marine he realizes the importance of having a Constitutionally qualified POTUS/CINC. 6. Judge stated that if Obama isn't Constitutionally qualifed he needs to leave the White House.

John McCain was born in the Panama Canal Zone, which was US territory at the time (before Jimmah Carter gave it away). I belive that his father was also stationed there at the time, in service to the US Navy - otherwise how would that effect the eligibility of future service brats who were born at the parents overseas posting?

You could also say he was being generous to the defense in not ruling for her summary judgment, given the procedural games the defense has been playing regarding service of papers .

My reading of the commentary by Leahy in the Senate non-binding Resoultion regarding McCain’s plac eof birth leads me to think the democrats set a trap for McCain ahd he won: Leahy stated that ‘since McCain was born on an American base and both his parents were American citizens at the time of his birth’ ... this was factually incorrect based upon the evidnece they cited! McCain submitted the proof that he was born in Colon, Panama. Also, Barry Obama inserted a phrase which would appear to try to give him cover for not being born in the USofA! I can post the wording for you, if you haven’t seen it yet.
As for McCain, there has been disagreement as to whether he was born in the Canal Zone or in Colon, Panama. If it were the Canal Zone, there would be no problem. (The McCain birth certificate posted over the Internet - indicating he was born in Panama - has been shown be FReeper Polarik to be a fraud, likely posted by a Democrat lackey.)
McCain was born to two Natural Born citizens of the United States. In reality, that alone makes him a Natural born citizen.
That is not the case with Barry Soetoro.
If that happened, the demcorat party would immediately seek to challenge McCain’s eligibility based upon not being born on U.S. soil. Count on it!

If it is proved Obama somehow got in without being vetted (doesn’t matter how really) it does not invalidate the election. Biden will have to take over per the constitution.
I think that mush is pretty clearly spelled out in the constitution itself.
Without the actual quote, it is something like, “if unable to carry out his duties” so just because Obama usurped the system for his office, the election is not part of what would happen with the due course of the constitution.

through the justice department. But the point is the date of filing was not after he was in office. it was BEFORE.
I think that this case slipped through the legal team he had in place.
The Senate resolution is irrelevant. Observe, even if the Senate passed a bill (which they didn't, they passed only a "non-binding resolution"); and the bill passed the House and was signed by the President (none of which happened); you would be permitting the Congress to effectively amend a Constitutional provision (remove the requirement that the President be a "natural born" citizen) without complying with the amendment provision.
In fact, the Supreme Court has historically reacted adversely to these kinds of things.
Colon Panama, and the hospital located there where McCain was born was not an American base; and even had it been an American base, that is also not relevant--the Constitutional problem is that Panama and persons born in Panama are subject to the sovereignty of that country; the framer's of the US Constitution wanted to avoid having a Chief Executive who was subject to the sovereignty of some other head of state.
It was generally known by the Constitutional bar in DC that McCain wasn't going to win so it didn't make any difference that he was not eligible.
