Robert A. Mark, the Judge overseeing Psystar's bankruptcy in Florida, ordered a hearing on Apple's Motion For Relief From Stay for June 17. Apple filed the motion in hopes of quickly resuming its case against Psystar for selling PCs with Mac OS X pre-installed.
Apple's legal battle was temporarily stalled when Psystar filed for Chapter 11 bankruptcy protection because of mounting legal expenses. Judge Mark would likely lift the stay eventually, but Apple is hoping to expedite the process with its motion and avoid losing more time while waiting for the bankruptcy proceedings to complete.
Psystar is still selling PCs with Mac OS X pre-installed without the Cupertino-based company's authorization, and Apple contends is "in violation of Apple's intellectual property rights... thus tarnishing the reputation of Apple's genuine products to Apple's obvious detriment."
Apple is also contending that without a resolution in its case against Psystar, the bankruptcy judge won't be able to approve a reorganization plan for the company.
Apple's case against Psystar is scheduled for a November 9 court date, but if Judge Mark doesn't approve the Motion For Relief Form Stay, that date could be delayed into 2010. Psystar has until June 15 to file a brief in opposition to Apple's motion.

It is nowhere near as clean as the Apple Cinema, but at this price, it is great for Hulu and Nascar! Plus, I am now able to run 47 screens at the same time (well maybe not 47, but quite a lot!). Next, I'm going to try my 42" Vizeo.Do you think I can have them all run from the MacBook? ;>)
One would hope a bankruptcy wouldn’t delay an order is, as seems likely, Apple has a legitimate claim. But you never know what can happen in a bankruptcy, as these past few months should make clear.
So I can easily imagine that, if I didn't have Apple hardware these days, but instead had some generic x86 hardware sitting around, that I'd try to make OS-X run on it.
I admire the hacking spirit (in the original old sense of "hack"), and proudly call myself a hacker in that sense.
But I would never go past that limit, and:
1. Manufacture and sell Hacintoshes.
2. Claim righteousness while doing so.
That's where I think Psystar is out of line. And deserves to get slapped down hard.
This stalling routine is just crap. They deserve to die and will eventually.
I hope it comes out as well as Chrysler, my stock me be worth less that I paid for it.
I run a 52 incher with a Mac Mini, so you should have no problem.
Phystar has some very powerful silent partners, I am afraid. This was just a probe bye some unnamed boys with deep pockets.
I have already hooked up the 42” to try it, but I want them ALL at the same time! I can open a lot more windows at one time that way!

Agreed on all counts. Apple has not gone after Hackintosh hobbyists — anyone with one of those *knows* it’s a hack, so if it fails to perform smoothly, that doesn’t harm Apple’s reputation. It might even help Apple in the long run by letting tech-savvy hobbyists have a taste of OS X.
Selling pre-packaged “Macs,” on the other hand, clearly hurts Apple’s reputation. When they don’t work as well as advertised, which is all but inevitable, users gulled into buying a Hackintosh will tell all their friends that Macs suck.
