The theory has NOT won squat it got it divine creation at the legislating of some dressed in black robes. Time is one thing NOT on the theory's side.
Do you think the theory of universal gravitation of mass is similarly dependent upon public funding? That if they stopped teaching it in public schools and researching it at public universities that it would wither on the vine?
But of course the TOE is completely dependent upon public funding, it is the first case of a permanent welfare class to be created in this nation. Gravity is one of those 'laws' set in motion when the heavens and earth were created and no amount of money will ever control the laws of gravity. Amazing how lofty minds attempt to compare things like apes to humankind as sameness of gravity to their own creation aptly named TOE.

Sure why not eliminate public education as legislated under TOE. Or require the producers of said public education to take responsibility for their products. But NOT one evolutionist will stand up and take responsibility for the outcomes of what their TOE has reaped. Now how many generations have been educated under the 'you are just a couple of steps away from the great apes Johnny and/or Susie?
If you're serious about this, then you're going to have put it in terms of things that actually exist. There is no legislation "under TOE".

I give credit to the ONE who created the double helical structure of DNA and planted into the WORD as evidence for those with discernment would know where credit actually belongs.
I also have no problem acknowledging the flesh beings that stumbled upon the structure of DNA, but they are not gods to me.

I have NO clue what British scientists were thinking about US judges declaration of the viability of evolution. The competitive nature of who got there first could mean many things about what British scientists were thinking.
So in other words, No. British scientists could care less about U.S. jurisprudence either for or against teaching evolution. Scientists worldwide use the theory for its explanatory and predictive powers,irrespective of public funding or U.S. jurisprudence.
The theory stands on its merits. It is taught in Biology class because it is the theory that Biologists around the world use.
Oh please, it is legislation by judges that gave birth to the public funding of TOE. There is NO oversight allowed for teaching little kids they are animals only demands for more money to teach more of the same nonsense. And since the inception of this highly esteemed ideology there is mass need for routine stops at the nurse's office for the daily drugs to sedate these kids because they act like animals. You teach a child they are animals and that is exactly what you are going to end up having at the nearest welfare lines.

Now some would consider your clever wording a personal attack. The TOE methodology is in total and complete charge of public education, how about the preachers of said theory take responsibility for their outcomes.

Therein lies the problem with the lack of discernment of how the application of the TOE does NOT stay in biology class. IF a child is taught in biology class that they are a few random steps of descent from the great apes, what makes you think they are NOT going to emulate a great ape walking to the next class or taking this primary animal behavior home with them? Based upon the condition of public education I say the evidence is on my side of all things considered.
First one would need competent teachers to teach the subject. The TOE is against God and yet in our very own founding it is the Creator that is acknowledged to be the giver of primary rights of Life, Liberty, and Pursuit of Happiness. It should be a 'right' to each and every citizen to be informed fully on what the theory claims without the artwork of course. And that a significant number of the population at large does NOT agree with the TOE.
Evidence of appeal to consequences?
Your initial point was that the theory was dependent upon public funding. Obviously this is not the case. Now you bring up the fallacy of appeal to consequences.
It didn’t make any more sense when Thomas Paine did it. The truth is the truth, consequences be damned (or forgiven as the case may be).
