DURHAM, N.C.—One of three Duke University lacrosse players charged with rape wants the case resolved in time for the next school year, his lawyer said in court yesterday. But the judge warned he will not fast-track the proceedings.
The case "is not going to jump ahead of the line and be handled any differently," Superior Court Judge Ronald L. Stephens said at a hearing for sophomore Reade Seligmann.
After the brief hearing, District Attorney Mike Nifong said he does not expect any trial to begin before next year.

I would have thought so. I'm not trying to divert the thread but a lot of Terry S.'s medical record was made public as a result of litigation.

If the defense didn't have the phone or records, how did they know the service had been canceled? Someone on that site suggested the boys found the phone and called that number. I wonder if that is one of the details the defense wants from the phone records?
I find it interesting that defense counsel knew the phone had been disconnected the day after the alleged assault...

True, but sometimes real life is more bizarre than anything one could come up with in fiction. It just seems to some of us that there is something more than meets the eye here, something nefarious.

My guess is that the defense has enough private detective and sense to get the FA's number and buy the phone records. They requested this in court because a) they want to see if any text messages or photos are on the phone. b) get the record into evidence.
Yes, and if Nifong thought the "genetic material" didn't come from a player he wouldn't have told the judge that ordering DNA from the whole team would implicate the guilty and exonerate the innocent.
But the "no condom" statement in an official record makes both the behavior of the AV and Nifong bizarre, i.e., not reflecting reality. We know the AV has had problems -- what about Nifong? Surely he knew this statement would come out? Methinks I see the tell tale signs of a sociopath, in which case those poor kids are in for a nasty, nasty time.
The more criticism is heaped on Nifong from "outside", the more those who live there will circle the wagons around him imo. I sensed that in Judge Stephens yesterday, who seemed to take umbrage at Osborn's worry that the DA wouldn't voluntarily do the right thing about discovery, and that the Durham PD might not handle the phone evidence carefully.
Duke is a private school so there's no such thing as "in-state tuition". They could award scholarship money to a student if they chose to but I am not aware of illegals attending. My son is a sophomore there.
Makes you wonder what else they know about that phone...
