Duke based initial gang-rape reactions on campus officer who eavesdropped on call

DURHAM -- A March 14 Duke Police Department report that downplayed gang-rape allegations against the school's lacrosse team stemmed from what a Duke officer overheard while listening to a Durham Police Department sergeant's cell phone conversation, City Manager Patrick Baker said Tuesday.

The Duke officer, Christopher Day, never actually spoke to the sergeant or conducted any follow-up inquiry before telling his superiors that the woman at the center of the case had changed her story several times, and that her allegations were unlikely to produce serious charges, Baker said.

I don't think it's harsh at all, but realistic. And what's more, practical, in the wake of the Duke case. If you're a white guy and you hire a stripper/prostitute, make sure you get a white one. That way, if something awry does happen, at least the race card is out of play.

Police did not search the house where the party took place for two days after the party. Baker has said the delay occurred because it took 31 hours for police to get the accuser to give a statement of what happened at the party

Which makes the statements about her changing her story 10 different times all the more believable...

I doubt they weren't getting statements, but they probably had to wait until they heard two in a row that were the same..

Baker has contradicted himself. He now says she gave the statement on the morning of the 16th which is clearly more that 31 hours after the fact. Probably an easy mistake for him to make...I just would think he would have covered himself better as to the delay it took for the PD to search the house. This case is making me ill.

Taking at face value the reports of Durham police officers (and perhaps others), and allow their interpretations of credibility and seriousness to shape Duke's thinking was a major mistake. Dean Wasiolek....do more to check out serious allegations on her own.... ...member of the Duke law faculty... Duke can't rely on second-hand quotes for credibility...

Maybe beginning an investigation within 2 days of notification is considered "taking it serious" by Durham city hall... when you think about it, what's 2 days lost when collecting forensic evidence?

Evidently time enough to alter time stamps on digital photos, but not enough time to get rid of the make-up bag and others items owned by the AV still in the house...

Yes, Wade "brought" him to NC:

In 1981, he returned to North Carolina, specifically to the politically well-connected Raleigh law firm of Wade Smith, a former Democratic Party state chairman, where he started a rapidly successful civil litigation division. He won his first multi-million dollar verdict in 1984, which he followed the next year with a $6.5 million verdict for a 6-year-old girl who'd suffered brain damage at Pitt Memorial Hospital---at the time, the largest verdict in state history. Edwards left in 1993 to start his own firm with Kirby.

According to abc copy of warrant the warrant was issued at 6:55 PM on Mar 16th..

In response to "they wore condoms and had rape proof hoodies on: Don't forget, her DNA should be all over the rug together with "hair" and clothing fibers, etc. and likewise, her clothing should have had rug fibers all over them.

We're being blindsided with the: "We're looking at the Duke DNA".

Exactly the delay in the search certainly looks to match a confused, unreliable witness.

The police are acting defensively about this because they don't want said to not have taken her seriously. I think they did take her seriously, but just found her not believeable.

The list of persons interviewed for the Bowen-Chambers report included no one from the Durham Police Department.

The manager, as he has in the past, also defended the department's handling of the investigation. Some people have criticized the department for not searching the alleged crime scene until March 16, two days after the alleged rape.

"Although we were not able to immediately interview the complaining witness upon our initial receipt of her complaint, we were able to complete our initial interview with her within 36 hours of the alleged incident and executed a search warrant for the 610 N. Buchanan Blvd. residence one day later," Baker wrote. "We also conducted extensive consensual interviews with three of the members of the Duke Lacrosse team immediately after the execution of the search warrant."


Is he serious? ;)

I want to let people know what is going on in Durham. I was on the road tonight at 5:50 pm EST and listening to 0680 AM, WPTF, the talk show's host is Bill LuMaye.

A black woman called in from Durham. She said that everyone knows the accuser. She said a neighbor of hers works in the DA's office and that the DA has kept the neighborhood updated on the case. She said IN THE NEXT WEEK, you are going to see evidence that absolutely PROVES one of the players raped this woman. She scolded the White callers to the show. She also said that her neighborhood KNOWS (they've been told) that the team ordered a Black stripper.
She went on that they basically wanted to abuse a black stripper and they're sick... (time ran out).

I'M NOT saying this is true. I'm saying this gives insight to how many of the black people in Durham feel about this case. This woman was incensed that White people don't believe this woman. And we know, some white people do.

If you remember most white Americans were shocked that a black Jury (O.J.) could hear a case for ONE YEAR and then decide the case in 45 minutes. Whites were shocked how much differently blacks viewed the case. I think history is repeating itself here (IMO).

Now, that's a good point. Too bad someone doesn't ask Wendy Manhater that question just to make her looks stupid.

I think the report and Wendy Murphy's reaction to it shows that she doesn't believe her own stats that XX rapes happen every 15 minutes. Here's why, If she believed Rape was so common than I'd think the implications of the report would cause her to worry for her daughter, sisters, and aunts. The report basically condones treating a rape of a minority with urgency and treating a rape of a White woman with due process.

She lives off Rape like Jesse and Sharpton live off Race baiting.

So this means that the DA is giving information about the case to an employee and authorizing her to release it only to the AV's neighbors?

Doesn't pass the smell test...

But then again, what does about this case?

I thought the part about ordering a black stripper may be Urban Legend.

Nifong has supposed told multiple people in the accuser's family about DNA tests and he has violated NC Bar rules as to making predjudicial public statements about a case that hasn't been tried, so if he has someone updating community leaders in black neighborhoods that would be consistent with Nifong at this point - Sadly.
