Florida State Attorney Dave Aronberg asserted on Tuesday that special counsel Jack Smith may resort to drastic measures to attempt to disqualify the judge in former President Donald Trump’s classified documents case.
Judge Aileen Cannon is presiding over the case against Trump and on Monday ordered the former president and Smith to submit proposed jury instructions, which means the judge is focusing on a trial much earlier than anticipated, according to The Washington Post. The order benefits Trump and Smith will appeal it as well as potentially try to disqualify Cannon, Aronberg asserted on MSNBC’s “Jose Diaz-Balart Reports.”
“My head is spinning because this is sort of an incomprehensible order by Judge Cannon,” Aronberg said. “First off, she’s asking for jury instructions on a case that will not be heard before the November election, and so what is the rush?”
Judges direct juries on how to evaluate evidence shortly ahead of deliberations which indicates that Cannon is focusing on the end of the trial already, according to the Post. Cannon’s Monday order indicates she is giving credence to Trump’s argument that he has the power to determine that certain classified documents are personal to him and his property.
“And then she set forth two different hypotheticals for the parties to engage in when it comes to jury instructions, but these jury instructions are really favorable to Donald Trump,” he added. “Essentially, you have two choices, Jack: heads, Donald Trump wins, and tails, you lose. So either way, this is just something that Jack Smith is not going to be able to take. He’s going to have to go to the 11th Circuit Court of Appeals … and try and get this whole thing changed unless Judge Cannon will do it herself.

Hey jack you ass, that is common in all defense of espionage cases involving disclosure of documents. It is why they are often pled out because the government does not want more disclosure. Here they know disclosure will show this is a joke of a case.

Perhaps theyre just pointing out his desperation-spotlighting the silliness of it all. If this judge can be removed , why not all the others who clearly have been shown to be biased in favor of the prosecution. This classified docs case is DOA- after letting Biden off - Jack has no standing anymore. Perhaps this is why the judge is moving things along now. He can make all the overtures he likes but the fact is Smith is up against it and he doesnt have many options.

Obviously, the President often needs to retain such writings after leaving office since backbiting by underlings is very likely after a President’s term in office ends.

Ok, Jack get the Judge off, it’s not like a new judge will have time to just start the trial next week. It would take weeks if not months to find a judge and for them to get up to speed. Jack I Don’t think this is your best move unless you want to save face and get the judge off and use her as the reason you failed! Never know in these crazy cases! Note I like how Fani is still on! They are many people in any administration who can write memos and classify them. Those same people can declassify them. Now it would seem someone else has a copy....with “0” knowledge of whether it was ever declassified. That’s how sneaky people work the system.

Thats the law, but Smith is losing it because those documents thet Trump declassified will reveal a plot to assassinate President Trump on January 6th.
Thats treason and espionage. People in DOJ, FBI and CIA will be put in chains , indicted tried and executedby firing squad ........

That’s not how it works.
Jack doesn’t want the jury to see what is inside the secret doc covers. Just wave the envelope in the air and tell the jury to trust them.
Cannon is calling their bluff.

PROSECUTOR: "That information is proprietary and confidential. It cannot be made public."
This case gets thrown out of court on the spot, and the prosecutor deserves to be disbarred permanently.
My reaction too...imagine if every prosecutor could just have the judge changed anytime they don’t like a ruling.
