---------------------------------------

8 U.S. Code § 1401 - Nationals and citizens of United States at birth....

https://www.law.cornell.edu/uscode/text/8/1401

RDMercEER:

It didn't matter where Obama was born, it doesn't matter where Ted Cruz was born, it didn't matter where John McCain was born, it didn't matter where George Romney was born. The phrase “natural born Citizen” has a specific meaning: namely, someone who was a U.S. citizen at birth with no need to go through a naturalization proceeding at some later time. If one of your parents was a US citizen, which is the case in all four examples, you are a natural born US citizen.

This has been Levin's contention all along. Dishonest leftists, such was Pruto and whoisyourdaddy may want to do a little research, before spouting our their Alinskyite lies. Can either of you provide a link where Mark Levin said Obama couldn't be President because he wasn't a natural born US citizen?

I still don't think Obama was born in Hawaii, but it is a moot point, because at least one parent was a US citizen (and with the possibility of Frank Marshall Davis being his real dad, perhaps both). By birth status, he has every right to be the president.

I believe it was the Naturalization act of 1952 that applies to Barack Obama.

I remember that the requirements changed. I detailed all that in FR posts at the time, but I don't have easy access to those posts now.

Because in the situation you are describing, when someone has lost their citizenship because they left the country, they’re not going to be eligible for the Presidency anyway so it becomes a non-issue.

That is a dodge of the question.

I can stay out of the country for the first 21 years of my life, and still be eligible to be President. These statute based citizens cannot do that.

Clearly there is something different about the sort of citizen I am versus the sort of citizen they are. My citizenship does not have conditions, but theirs does.

How can they be the same thing with such an obvious disparity of outcome?

Should you actually read Wong Kim Ark, it will explain that all to you! But I suspect that it will do not good for you to read it, because, like The Sovereign Citizen, you will never admit that you are wrong.

Let us find out which of us is more like the "Sovereign Citizen."

Here is an excerpt from Wong Kim Ark. (Paragraph 113)

"Every person born in the United States, and subject to the jurisdiction thereof, becomes at once a citizen of the United States, and needs no naturalization. A person born out of the jurisdiction of the United States can only become a citizen by being naturalized, either by treaty, as in the case of the annexation of foreign territory, or by authority of congress, exercised either by declaring certain classes of persons to be citizens, as in the enactments conferring citizenship upon foreign-born children of citizens, or by n abling foreigners individually to become citizens by proceedings in the judicial tribunals, as in the ordinary provisions of the naturalization acts."

You will die and go to Hell before you ever admit that the fringe on the flag is meaningless,

Nah, i'll do that right now. The fringe on a flag is meaningless. That whole business about it being an "admirality flag" is just silly crap. I've never believed that and I don't grasp why anyone would.

Nope. Birther and Sovereign Citizens were transexuals in mindset before trannies became a thing - self identifying as whatever based on their subjective whims.

That sounds like propaganda. I can't speak for others, but when this stuff broke, I researched it myself, and along with the research from others, I learned a great deal about it's origins and how it's meaning changed over the years.

One of our number even found a law book from early 1800s Pennsylvania that explicitly says the meaning comes from Vattel. Rxsid are you out there?

I researched this topic for several years, but that was a decade worth of posts ago. I'm sure they are still on Free Republic's servers somewhere, but to find them now?

Very hard.

Levin is a lying liar!

Citizen at birth does NOT equal Natural Born citizen!

The 2 are completely different!

Just because they are not the same thing in every respect does not mean they can't be the same thing in some respects.

A half dollar coin is equal to two quarters, but are they the same?

Well they are same in value, but just try putting a half dollar into a quarter slot and see how that works out.

I think proving that they are different, proves that they are not the same thing, and the residency requirement proves to me they are not the same thing and they never were the same thing.

They are both citizens at birth. Right?

Well I hate to parse this, but in my opinion a natural born citizen is a citizen before birth, while these statute based citizens have (naturalized) citizenship conferred upon them at birth.

If congress had never passed a statute, they wouldn't be citizens, so therefore how can they be natural citizens if they require intervention to make them citizens?

Would the Constitution have been written to allow a dual citizen with dual loyalties to become President.

Let’s say an English/US citizen?

And what was the reason for the grandfathering in of “a citizen at time of writing?

He’s been wrong before. If this is about Cruz, let’s not even mention the fact that Cruz remained a Canadian citizen into his 40s.

Excellent point.
Natural born citizens are naturally citizens and do not require any statute to confer citizenship.

You may be correct, but please don't take this the wrong way. I do not believe something simply because someone tells me it is this way. I usually have to see something that convinces me it really is this way.

I have seen and read this law a long time ago. I'm pretty sure it is the naturalization act of 1952. I've looked it up myself several times, but I no longer recall exactly what it said, and it might be as you say, but I would be more inclined to believe it if you could post the excerpt from it that says this.

I just remember Stanley Ann Dunham didn't meet the residency requirements outlined in the statute.

Enough of this nonsense...

U.S. born or foreign born, the only important issue is that Americans blindly voted (twice) for a known communist whose parents were both known communists...

All long-term hope for restoration of the former Republic totally disappeared during those 8 years...

Now it is even worse, the second communist administration is fully implementing the dark & enduring tyranny associated with all prior communist governments everywhere...

The American people have shown no real or substantive inclination to restore even the simplest of freedoms...

On the positive side, there are now only about 998.7 years (based on Ronald Reagan’s prophesied 1,000 years) left of this growing and expanding tyranny...

I think Levin is wrong.

Bingo!
(And his current argument has been thoroughly examined in these pages over the past several years.)

The founders very clearly distinguished in the Constitution with references to two groups of citizens regarding parentage, those qualified to serve as Commander in Chief and those who were not.

In the absence of an amendment to the Constitution, and notwithstanding any statute to the contrary, the intent of the founders is to prevail over any other interpretation.

Can a US citizen, who has immediate family (parents), who are foreign citizens and residents get a top secret/sensitive compartmentalized information (TS/SCI) clearance?

60 Years ago, no supposedly,

However, a Navy CT Chief and friend married a woman, who was Ethiopian and Italian. A year later, he was assigned to the
North Hampton while JFK was Potus. The Hampton had a Presidential Office reduced in size on the ship with a blue carpet and a rocking chair. That was in the 1960’s before JFK was killed.
