Don’t count on Roberts and Kavanaugh and Barrett are undependable.

Yes.. someone on the thread mentioned Jan. 7th as the date of the hearing so that fits. So it’s about the OSHA mandate... that is serious. If it were about the military or even military contractors, unless it involved religious exemptions I doubt it would have been heard so quickly.

I didn’t count on Roberts. That’s why I said a 5-4 Conservative majority. I hope Kavanaugh, and Barrett hold the line.

I’ve lost my faith in the Supreme Court to do the right thing on any issue put forth to them.

I think they will split it and say that he has authority as executive over government workers but not over private citizens.

That covers all the departments, independent agencies and the like.

The military is under Defense Department so the mandate would apply to them. Joe Biden should be able to use it as a mandate over federal workers not as an OSHA regulation which isnhus argument.

#SCOTUS will hear arguments in both the CMS mandate (for health care providers that take Medicare, Medicaid) & the OSHA mandate (for employers with 100 or more employees).

Good.. then it is more than one case.. that explains the use of plurals in the news blurb.

Would the mandate be amended to include the new Pfizer pill?

There are at least half a dozen different federal mandates.

Call me a nut, but I’d bet the OSHA mandate goes 9-0 to overturn the mandate.

The CMS (Medicare/Medicaid/healthcare worker) mandate? Probably 5-4 to overturn.

Not a chance. They will uphold all of the mandates as they have from the start of this mess.

Unless Deep State has decided to cut its losses and will use SCOTUS to do it.

Don’t be surprised if it’s unanimous to enforce mandates...these people all live in lib enclaves and they are shown and told every day about how deadly covid is.

It will probably come down to just how much power Congress has given OSHA in the fine print... the devil’s always in the details.

“And if Biden walks in with his OSHA argument, I do not see that flying.”

It matters not whether we not see it flying. Xiden had nothing to lose by an OSHA mandate. So it doesn’t go forward, no problem, he’ll say “he tried.” The Supreme Court lives in the DC bubble. It as an institution has a history of rendering some very bad decisions that have greatly hurt and/or killed many people and has destroyed individual liberty. It favors federal givernment (obozocare) except when someone like Trump is elected, or leftist outcomes are involved. I wouldn’t trust the court for anything. For example a court to find very recently that homo-marriage is a constitutional right should tell you it cannot be relied upon. All bets are off 50:50 OSHA mandate sticks because it allows for weekly testing.

The court has already upheld NY Medical mandates that nullify religious exemptions. Don’t expect anything good from this court
