Writer Catches the New York Times Accidentally Reporting Who Sabotaged the DACA Decision at SCOTUS

Ms. Duke’s most lasting legacy is likely to be the memo she signed — under pressure — to end that program. Her decision not to cite any specific policy reasons was at the heart of the Supreme Court’s ruling, which said the Trump administration had failed to substantively consider the implications of terminating the program’s protections and benefits.

Ms. Duke said she did not include policy reasons in the memo because she did not agree with the ideas being pushed by Mr. Miller and Mr. Sessions: that DACA amounted to an undeserved amnesty and that it would encourage new waves of illegal immigration.

Sounds like it was Sessions. He might have been one up from her supervisor.

And so does this mean that Trump has a do-over coming to him? Or that it’s just another “oops, sorry, too late to change it, move along” BS statement that will be forthcoming from the SCOTUS Tribe of Infidels? (With the exception of 2)

No wonder she was told to take a hike after just a handful of months. If you don’t support the president you serve, you shouldn’t continue to serve that president. Period....

Hire more swamp creatures to halt dark state...

Everyone involved in selecting executive branch employees and specific task assignments, use USAians not our enemies. Otherwise, We-The-People; many of us come to know that it’s just an illusion; a pretend, make DC lawful again.

Let’s all do back flips, off of the high dive, when Trump ever gets a mulligan...for mistakes made by the swamp, on his behalf.

“Who was her supervisor???”

I don’t think it was Sessions. DHS isn’t under DOJ.

"And so does this mean that Trump has a do-over coming to him?"

He's had it all along. It was challenged because the order supposedly didn't follow the procedure. All he's ever had to do is rescind that order and do it properly. It would have been much quicker than spending all this time in court, although I think they expected to win. He can still do it.

It’s irrelevant. The APA has no application to an Executive Order. It’s all a smoke screen. Robert made up a phony reason to sabotage the case. He is being blackmailed or, worse, he’s a stink’n liberal masquerading as a conservative.

It is amazing how much President Trump has accomplished seeing as how he has been surrounded by enemies his entire time. Unfortunately, he doesn’t have many accomplishments that will be long-lasting due to same. Supreme Court is his biggest long-lasting triumph, and whatever portions of 30-foot high border wall he manages to complete in the next 4 years. Other than that, most of his accomplishments can be undone, but I’ll take it. Better than having Hitlery for president all this time.

Still, if he had not been surrounded by enemies, he could have made true, long lasting changes.

This DACA business is just a load of horse manure IMHO. I am willing to bet that most of the folks that DACA would send home have known that they are illegals for quite some time. Should that be the case, why has it not occurred to them that they should apply for USA citizenship? Even if it takes a few years to be granted citizenship many of them would be legal now and would not be under DACA pressure. If they are not smart enough to figure out something this simple, we don’t want them here anyway polluting the gene pool.

Yes, I don't see that DACA applies.

It just is an excuse by Roberts to cover his treasonous actions.

I suspect blackmail, but, occasionally, he seems to make a correct decision.

Oops. I meant, I don't see how the APA applies.

The APA is being used as an all purpose anti-Trump, anti-Constitutional weapon.

I don’t care. What Ms Duke submitted for the court brief should have been scrutinized at more than one level above her before it became the official administration’s submission. Who at the White House and DOJ let her get away with it? THOSE heads should have rolled along with hers.

Well it certainly sounds like the Trump admin forgot to conduct some basic oversight of their employees doing some pretty major things.

BUT, if the SCOTUS decision was simply based off this one memo, wouldn't it be pretty easy to produce some meeting minutes or other correspondence showing that the admin did look at the implications of terminating the program? Which completely flips the SCOTUS decision around? There's NO WAY they didn't talk about the process at all, for something this major politically.

Of course, this is ignoring that it was unConstitutional in the first place, or that the program ended on it's own anyways since it wasn't renewed.
