(vanity) An easy strategy for Mitch McConnell

McConnell should declare something like this:

"Because the articles of impeachment have been made publicly available, the Senate deems them 'delivered' -- the House has six hours for their managers to present themselves to participate in the process. Otherwise, we will begin without them, and no one will be allowed to join the process once we've started."

“Meanwhile the House and Senate will remain in session without break”

I like it, am fuguring someone on “our” side has already thought of that.

Though “we” sure do seem to like to take lots of time and give Rats every opportunity to commit plenty of crimes before pushing through any zingers.

McConnell should just copy the Democrats. Do anything at all possible to make it a bizarre, illogical, theater of the absurd, with the veneer of deep solemnity.

Americans are already fed up with it. Just push public opinion completely over the edge.

That would be a great strategy:

1) All of the Leftists’ heads would explode.

2) The House Dems would take it to Court to get a TRO and would either win or lose.

If they lose, this thing is over.

If they win, then the question of why the Dems are delaying the trial of Trump (whom they were saying as recently as last week is “too dangerous” to be POTUS) will be right in everyone’s face.

Either way, they lose.

Trump must be laughing his ass off at how stupid the Dems are. They just guaranteed his reelection.

I think the important point here is that the Constitution provides some immovable truths: House impeaches, Senate tries.

The House has said it has impeached.

Its job is over.

The Senate does its job next.

NOW...in a normal world, where the relevant institutions are trying to implement in good faith what the Constitution requires, then it makes sense to have rules that govern timing, procedures, blah blah blah.

But what Pelosi is talking about is trying to elevate these secondary procedural rules to a point where it actually thwarts the Constitution.

That don’t work.

The House doesn’t get to hold impeachment until it is satisfied with what the Senate will do with trial.....any more than the Senate gets to decide that it is satisfied with the House impeachment before trying.

Each house of Congress gets its turn to speak, in succession.

(That said, it is certainly valid in a Senate trial to swiftly dismiss. That’s the prerogative of any trial court.....).

McConnell’s other choice is to table it. He indicates, according to Drudge, it will be DOA.

Nope....just have POTUS call them to convene for the purpose of a rapid trial (since he is so dangerous). Keep them in DC for Christmas away from their families. Send federal cops to chase down the absconders:

[The President] may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper.... Article II, Section 3

Go one step further.

The rules used by the House during their investigation will also be used in the Senate. However, to ensure fairness, the President or his representative will assume the role of the committee chairman and the House managers will assume the role of President Trump.

No!. Upon the senate being gaveled in in January PDJT needs to file an emergency writ of mandamus with the USSC demanding that the house immediately send the article of impeachment to the senate and if they refuse then the USSC should declare that the articles of impeachment is null and void. The senate needs to join the writ and also demand the articles be sent to them. The house needs to get a strong rebuke by the USSC.
