In a move that has the Plantiffs "amazingly overjoyed," Judge David O. Carter has turned down the Governments motion for Dismissal in the case of Barnett vs. Obama.
"This is a victory for democracy and the people of America," Rancho Santa Margarita-based attorney Orly Taitz said after this mornings early meeting in the Judges offices.
"This means that, come January, the President of the United States will be forced to come into this same courtroom and explain his massive fraud to the American people."
Taitz represents Capt. Pamela Barnett and other military officers who question orders from the commander in chief, as well as Presidential Candidate Alan Keyes. She has tried similar lawsuits elsewhere, but has failed, most recently in Georgia, where U.S. District Court Judge Clay Land not only rejected the lawsuit Taitz filed, but then fined her $20,000 for filing a "frivolous" appeal.
Taitz is joined in this lawsuit by Ramona-based lawyer Gary G. Kreep, who unsuccessfully tried to sever his case from hers.
"Im astounded, quite frankly," Kreep commented. "I really thought, after the last Court session, that we werent going to get this far. I guess I should have given Judge Carter more credit than I did."
The case revolves around whether Obama was born in the United States. In the previous hearing, in which the Government presented its Motion to Dismiss the case, Carter seemed skeptical that a courtroom was the appropriate place for such a matter to be decided.
Department of Justice attorneys Roger West and David DeJute had argued that only Congress can remove a president through impeachment. The only way the courts could be involved was to have the chief justice of the Supreme Court preside over the impeachment trial.
Both West and DeJute refused to comment.

This item is just breaking and I would consider it as "Not Verified." There are only a couple of sources on the Internet at the moment, and Taitz doesn't have a comment on her blog.

What? Stop believing everything you see on television. The judge is going to write his ruling, then hand it to a clerk who's going to enter it into the official record, and then into the case management system known as PACER. No one is going to be "in the courtroom" and no one is going to "put restrictions on Orly about letting the news get out".
Plaintiff's and Defense counsel are going to find out about the decision the exact same time as everyone else - when it's posted on PACER. If it's not on PACER, then there's no decision.
The stupidity that surrounds this insane circus is an embarrassment to real conservatives everywhere.

I will be really surprised if Judge Carter actually ruled against Obama. Read the following:

Bauer, one of Obamas top lawyers is a partner. And that, just days before the Oct. 5, 2009 hearing on the Motion to Dismiss, in which his demeanor radically changed, according to Dr. Orly Taitz, esq., lead counsel for the Plaintiffs.
Siddharth Velamoor is the lawyer chosen by Carter to serve as one of his two official clerks, from Oct. 1, 2009, till Sept. 30, 2010, according to Wikipedia. Velamoor is listed as an associate with Perkins Coie, LLPs office in Seattle, Washington. It is not clear if he has broken his relations with the firm.
Robert F. Bauer, is a partner of Perkins Coie, LLPs office in Washington, D.C.. His bio at the company identifies him as holding the Chair of the Political Law group at the firm; general counsel to Obamas Campaign for America and general counsel to the Democratic National Committee.
Mr. Bauers wife is none other than Anita Dunn, the Whitehouse Communications Director.
Mr. Bauer, who represented Obama in a case challenging his eligibility in the spring, wrote a letter on April 3, threatening a citizen if he should continue to seek justice in the courts. You can read more about that case and letter here.
Since it appears that Siddharth Velamoor could be influenced by Perkins Coie, if the case did not go Obamas way; his presence in Judge Carters chambers clearly impugns the integrity of the court, and will be the cause of dismay among the general public. Think of what a sick mind it takes to fabricate an announcement like this given the gravity of the issues at hand. Wouldn’t surprise me if one or more of our FR obamanoids were the source for a false info release.
