The Hawaii Department of Health has reversed course. They now admit that they do - in fact – make some vital records information available to the public. This admission reverses their prior response pattern indicating that “no information” could be released.

Then you need to look to what constitutes a valid marriage in Kenya. They accepted tribal marriages.

Good grief, the marriage index means nothing when it comes to UK citizenship law because it was not a valid marriage.

How many times do you have to be told that a marriage is a contract. You can’t be a party to a marriage contract in Hawaii when you are already married. The marriage was VOID...NOT VOIDABLE. The marriage WAS VOID in Kenya. It was VOID in the UK. It was VOID in the US.

IF YOU ARE GOING TO CLAIM IT WAS A VALID MARRIAGE...then find out whether Obama would have had to register.

You could also set about trying to make the case that not all the steps were taken for a LUO marriage to take place. They were clearly married. It doesn’t take much to marry someone in the Luo tribe.

I have seen Kenyan cases where it revolved around a Judge declaring that not all steps were taken and the groom could go ahead and marry another wife. But to totally ignore the issue and pretend it doesn’t matter is just folly.

The problem with Mr. Donofrio’s case is that it’s federal law that actually prohibits the release of the original birth certificate. The Health Insurance Portability and Accountability Act of 1996 prohibits the release of personal medical information by both public and private organizations. The birth certificate is regarded as personal medical information. Hawaiian State law that specifically prohibits the release of this information is derived from requirements of this 13 year old federal legislation. This is the reason that no State legislature in the country, including Hawaii, has taken action to legislate that birth certificates are publically disclosable information.

Keep in mind that the very same information made public by Hawaii DoH was presented by the official notarized certification document made available by the Obama campaign last year. Fukino’s and Okuba’s statements do not offer any more information than already disclosed by DoH when they issued the notarized certification. Mr. Donofrio is wasting his time.
