New case to demand evidence of Hawaiian birth

The chief of Hawaii's Department of Health twice has issued statements trying to convince doubters that President Barack Obama was born in the state, and now those words may backfire if a new legal challenge that is being developed comes to fruition.

Leo Donofrio, who brought one of the first legal challenges to Obama's eligibility to be president and unsuccessfully tried to get the U.S. Supreme Court to get involved at the time of the election, is reporting on his website that Hawaiian state law requires "information collected and maintained for the purpose of making information available to the general public" be released.

It was in July that Chiyome Fukino issued a statement on the subject of Obama's birth:

"I, Dr. Chiyome Fukino, Director of the Hawaii State Department of Health, have seen the original vital records maintained on file by the Hawaii State Department of Health verifying Barack Hussein Obama was born in Hawai‘i and is a natural-born American citizen. I have nothing further to add to this statement or my original statement issued in October 2008 over eight months ago."

It was in 2008 at the time of the election she stated:

"There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate. State law (Hawaii Revised Statutes §338-18) prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record.

"Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawaii State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures.

Interesting in how this TerryK approached this.

"This was not originally an action to reveal his actual BC and personal vital records info...the original requests (by TerrK) were for records pertaining to whether he requested his file for the purpose of amending and whether he did amend... the actual contents of his personal vital records are protected, she wasn't asking to see those. She was asking whether he paid any fees to amend them and whether they had been amended... not the contents of the amendments.

"However, I am going to raise the issue that since Fukino made a public statement about his place of birth, then all records viewed by her for the purposes of making that statement are supposed to be made public under 92F-12(15), information required to be made public. Regardless, the other statement she made about him being a natural born citizen involves a whole other can of worms concerning the advice of the Attorney General and it is the AG opinion letter that we are really after and which was denied to TerriK. The statutory and case law indicates that this information MUST be made public. That means we should get an answer as to what definition of nbc Fukino used to make that statement."

When Fuk-if-i-no released that statement on Barry being a natural born citizen, I knew the fix was in.

Apparently, Leo and Co. are looking into how Fuk-if-i-no and the Hawaii Attorney General Mark Bennett collaborated on her statement.

I heard the audio when the Gov made the statement. IIRC. I could be wrong....played it 3 times, she never said Zero had an original Hawaiian BC....just she had seen the BC.

Interesting. It was in 1961, the year of the Anointed One’s birth, that I first became aware of that classic Pacific novel “Hawaiian Rape”, by Kaman Aiwanalaya.

It could bolster his claim to native birth in Hawaii.

I believe the issue is whether the original records can be viewed as having been collected or gathered for the purpose of making the public statement. Obviously, they were not. Fukino states she reviewed Obama’s documents in Obama’s file. Is it fair to say that she gathered and collected those documents for the purpose of making the public statement. I am not so certain that her activities would be described as such.

I believe that Fukino made the statement that Obama was a ‘natural born citizen’ on the basis of Pelosi’s sworn certification representing that he was Constitutionally qualifed to be president.

It was about that same time that I read Michener's Hawaii. No kidding. I was 6 years old, and the back of the soft-cover edition held a supplement called "The Golden Boys" or something like that. Extremely racy and salacious for a first grader, but I was always a very weird kid.

By the time I went to grade school I had read most of my parents' college textbooks. Biology, Zoology, Psychology, etc. Very dry compared to Jimmy Michener, but altogether suitable for fulfilling my voracious need to read and absorb.

I didn't have alot of friends.

Actually Fukino consulted the Hawiaii AG before she made the statement about NBC for Obama. The AG sent her a letter or memo telling her how she could reply. That letter/memo is what this TerryK is after. Find out what that says and then you can ask the AG how he/she made the decision on NBC and what the documents he/she relied on for the decision.

It is quite simple all this TerryK is after are documents of communication, if they exist, between Obama and the Hawaiian DoH and also the AG's NBC communication to Fukino.

Heck, don’t laugh, my favorite TV show in 1960 (I was eleven) was “James A. Michener’s Adventures in Paradise”.

I was tired of all the western episodes (except for the different models of guns!) and brunette girls in sarongs were my early turn on.

The problem with that statement is that the part about Obama being "Constitutionally qualified to be president" was removed from the certification sent to the States by Pelosi!
