Firearms Freedom Act Introduced in Florida

Introduced in the Florida House on July 6, 2009, the “Firearms Freedom Act” (HB-21) seeks to provide “that specified firearms, firearm accessories, and ammunition for personal use manufactured in state are not subject to federal law or regulation” in the State of Florida.

The bill is sponsored by Florida State Reps O’Toole and Plakon. They follow in the path of Montana, and Tennessee who have already passed such legislation. And they join with Utah, Texas, South Carolina and others who are considering it in an effort to limit federal regulation of guns, and specifically invoke the 9th and 10th Amendments as restrictions on federal power:

“the regulation of intrastate commerce is vested in the states under the ninth and tenth amendments to the United States Constitution, particularly if not expressly preempted by federal law. Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition”

When I joined the Air Force in 1987, the military had changed its policy (not sure if it was a law, regulation, policy) on drinking on base. Essentially, it used to be if you were on base, and in the service (not somebody's kid) you could drink. When I joined, that had changed to the base having to abide by local law.

Most of the old-timers who were there basically took the attitude of you can drink, but don't get the unit into trouble. They were pretty good. They usually asked someone to keep an eye on us younguns to make sure we made it back to the barracks without hassle from the Security Police (MPs where I was, since my first training assignment was on an Army base).

If there are any black Freepers, please FRmail me because I have quite a number of poster which make clear the historic fact that gun control in America was invented in the South when the KKK night riders discovered dirty cotton sheets were not made of Kevlar, so to speak.

Having made this momentous discovery, they passed gun control laws, so that KKK night riders could ride forth and plan on riding home again.

The Supreme Court threw out the first ones, but then lawyers began their dirty deeds and eventually gun control laws were written that the Court accepted.

Time we made minorities aware of who created gun control laws and why.

And, they can, and have, changed many a Liberal’s views of guns.

Hoorah! I love living in Florida, the most liberal 2nd amendment state in the Union! And yes, it is liberal, as in protecting civil liberties - of which gun ownership is certainly one.

You are spot on! My argument would be that since the 2nd Amendment only applies to the federal government (as has been held by the courts) The states are more than justified!

Either the 2nd is incorporated or it isn't. The black robes have painted themselves into a corner :>)
