Firearms Freedom Act Introduced in Florida

Introduced in the Florida House on July 6, 2009, the “Firearms Freedom Act” (HB-21) seeks to provide “that specified firearms, firearm accessories, and ammunition for personal use manufactured in state are not subject to federal law or regulation” in the State of Florida.

The bill is sponsored by Florida State Reps O’Toole and Plakon. They follow in the path of Montana, and Tennessee who have already passed such legislation. And they join with Utah, Texas, South Carolina and others who are considering it in an effort to limit federal regulation of guns, and specifically invoke the 9th and 10th Amendments as restrictions on federal power:

“the regulation of intrastate commerce is vested in the states under the ninth and tenth amendments to the United States Constitution, particularly if not expressly preempted by federal law. Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition”

I don’t care for the language that seems to indicate congress could, if it chose, regulate intrastate commerce. Am I reading this wrong? Seems to me this one is just begging congress to pass such a law and they would run away with their tails between their legs.

Um no.

Senator Curt McKenzie, the guy that wrote the Idaho preemption bill (now law) that put the kibosh on Moscow, ID (and any other counties or cities thinking about the same thing) trying to ban guns inside city limits or public areas.

No, not if they follow the other states examples, full auto explosive ammo, etc. is specifically exempted from the state use only ans still falls under the federal control. This is "aimed" at possible semiauto and magazine capacity bans.

These acts actually are a lot more substantive, though more narrow, than the “Sovereignty Resolutions”.

They target a specific set of laws and rights,
and essentially nullify federal regulations.

I love my state when it comes to gun rights...

You're not kidding - me too.

A while back my wife and I were considering re-locating out of state. One of the MAJOR considerations for me - as a gun enthusiast - was gun laws in other states as compared to Florida. So, I did some research on the gun laws of various states we were considering, and I even looked into the gun laws of several foreign countries

What I discovered was that Florida has some of the best gun laws in the country, and in the world for that matter.

For all of Florida's real or perceived faults, it's a great state (perhaps the best state) to live in if you're a gun owner.

I would not be surprised at all to see this bill pass. A lot of politicians will likely vote for it to keep the mostly conservative constituencies in the Western, Central and Northern part of the state happy.

Our only real problem area is the Southeast region.

I did some research into other states and found we really are a great state to live in with many of the gun laws we have not forgetting the castle law which us and TX has.

You’re right about the south east.

I reckon it will pass easy as we are run by mostly republicans.
and well sort of crist who I hope goes away for a better person
