But if the Constitutional contract at this most fundamental level is abrogated by the courts then you and I no longer have a valid Constitutional contract because you have no standing to challenge the 'other side of the contractual entites.'

I really don't think the issue is dead, nor will it be for some time. There are sill cases pending before SCOTUS and other cases on their way through lower courts.

As for what SCOTUS will do, it is certainly not known yet. Remains to be seen. I do know that once Barack Hussien Obama aka Barry Soetoro places his hand on the bible and takes the oath, he will have committed perjury. Why? Because he knew he was not constitutionally qualified to hold office and would be swearing to uphold the constitution he has already violated. Just my opinion, of course!

but what about all the election, swearing in, appointees, laws, being null and void if he is found not legit. Biden would not be president it would have to go to Peeelosi till another cannidate or decision on what to do could be decided.

But I am profoundly under the impression there will be NOTHING DONE so that a national riot is avoided.

I've said this before in this forum going back several months now ... Barak Hussein Obama will be Americas first affirmative action president. Geraldine Ferraro said as much last spring when Hillary was still trying to hold on ... the only reason a young one term senator with a razor thin resume is still in the running ... is because he is, who he is ... you don't need be a rocket scientist to figure out what she was implying. Geraldine, of course, was condemned by liberals in the media for her comment ... but hit the issue head on.

Well, I guess we will see soon if SCOTUS does anything more than what they have already done. It is true that they have denied writs for stays in the election/electoral process in four cases. But from what I have heard, there are still parts of various cases that are still pending. There is also another case going to Conference on the 23rd.

As for the order from the Conference this past Friday on the Berg case, it is expected to be posted tomorrow morning. But since tomorrow is a holiday, I have no idea when it will be posted. It is beyond my understanding why all the orders are not posted on Friday afternoons. Some are posted on Friday afternoons and some are held for the following Monday. Why, I do not know.

It seems to me that there is a hole in the Constituion in this particular situation. Assume for a moment that Obama is not a natural-born citizen, and is therefore not qualified to serve as President of the United States of America...

Who enforces this?

• The Supreme Court could refuse to swear him in, but that would be neglecting their duty. It might cause a ruckus for a little while, but I'm sure they'd find someone willing to swear him in, and in a big hurry. And if he wasn't sworn in "in public" they could always claim some "emergency" and later tell us it was done in a "private ceremony" - so there is nothing the SC can do to prevent the swearing-in from happening.
• So he will be sworn in. Now, again assuming he is not eligible, an actual crime has occurred. But he's officially the President, so he has to be impeached to be removed - and the Democrat-controlled House and Senate will not do that (under any circumstances)
• But - again assuming he is not eligible - since the sitting President would be an usurper, arguably impeachment is not necessary and he could just be summarily arrested. But by whom? That duty would fall to the executive branch, which is controlled by...the President! Biden could theoretically claim authority and have it done, but of course he wouldn't do that to the man that gave him the job in the first place.

So there we have it: three strikes, and we're out of options.
