Burger King ads mislead customers about the size of its burgers by 35%, class action lawsuit claims

Burger King has been accused of deliberately using its ads to mislead customers as to the size of its burgers in a federal filing representing more than 100 patrons who say the fast-food giant's marketing practices constitute 'consumer fraud.'

The class-action suit, filed Monday in US District Court in Miami, claims Burger King brass, through a rash of recent ads for some of its menu items, knowingly deceived customers with images of mammoth-sized menu items noticeably larger than their real-world counterparts.

According to the 26-page filing, the fast-food firm 'overstated' several of its menu items - including the iconic Whopper - by as much as 35 percent in misleading marketing images, beefing them up to coincide with an ad campaign that touted larger portions at the eatery.

'Burger King advertises its burgers as large burgers compared to competitors and containing oversized meat patties and ingredients that overflow over the bun to make it appear that the burgers are approximately 35% larger in size' to coincide with a 2017 marketing campaign that touted the increase, the suit states.

The complaint also contends marketers used 'oversized patties' in shoots for the advertisements, that made menu items look as if they contained 'more than double the meat than the actual burger.'

The plaintiff seek 'to end Burger King's unfair and materially misleading advertising' practices, which has seen the chain tout larger portion sizes - namely for its Whopper and other signature sandwiches - when compared to other fast-food eateries.

The suit argues that Burger King execs' trade practices are 'unfair and deceptive' in how items are conveyed to its customers, and calls for monetary damages 'fully compensating all individuals who were deceived' by the company by purchasing 'overstated menu items.'

At home I make 8 ounce grass-fed burgers and put them on a brioche bun with swiss cheese and sautéed mushrooms.

You only need one and it blows the fast food burgers right off the planet.

It looks like the customer gets a lot more bun with the ‘actual’ versus that tiny bun on the ‘advertisement’.

I can relate. When I was a kid, McDonalds led me to believe that all McDonalds were staffed by clowns. That is simply not true! So I sued them for $1000. That was 40 years ago. I have not heard from my lawyer in quite some time. I sure hope my lawsuit is still on track.

Just use a smaller bun.

Haven't been to BK in years, since I got a burger wrapped in rainbow paper.

Answer, "We're celebrating homo pride month."

I said "Pass it on to corporate, but, tell them that equating their burgers with anal sex is not a good marketing strategy."

Seems like every ad I see on TV is exaggerating the black population of America. And from what I see on FR, a lot of them are shooting up Burger Kings.

Burger King did hard to have legitimately larger regular burgers. Clocking in at am 1/8 of a lb vs mcd’s 1/10th of a lb. But they shrunk them down to 1/10 of a lb years ago now…

While I’m against frivolous lawsuits I sort of agree with this. It’s false advertising.

Rather than making 5 people rich the award should be a drop in price for every one until retribution is served.

PS I got nailed bad by Arbys last fall. They over exaggerated their fish sandwich to a silly extent as in easily double the size in ads as what was served.
