Over twenty-five percent of Americans, say that President Obama's 49th birthday is not this week. A poll called “where were you really born that day?” summoned this up into question.
The persistent theory boosted heavily by conservative activists that Obama was not born in Hawaii, but that he was born outside of the country of the U.S. The CNN/Opinion research Corp. survey said 27 percent of responsive people doubt that Obama's father is telling the truth or that his birth certificate is real. 42% have no doubts, 29% said he probably was born in Hawaii, but couldn't give a sure answer. Democrats backed Obama more than Republicans. 14 percent of Republicans said he was NOT born in the United States. This issue began over Obama in the 2008 presidential campaign and has become a topic of interest with Rush Limbaugh and the so called 'Birther' movement. Hawaii has already released a “certified” copy of Obama's birth certificate. The 1961 archives of two local newspapers in Hawaii also show his birth announcements! Snopes.com has also checked into it.

If the Supreme Court found that Obama's presidency was unconstitutional, I bet there would be plenty of Federal judges who would issue a warrant for his arrest when presented with proof, and the laws that he violated or is in violation. The same proof that the Supreme Court found that Obama was not eligible to be president.
if that were to happen, I think that Obama would give a response very much like the one that Jackson made, “Mr. Marshall has issued his decision, now let him enforce it.” In other words, such a declaration would go nowhere, either because Obama would ignore it or a higher court would overturn it. So, we are back to the impeachment route.
You'd find many federal officers at that point who would honor their oath to protect and defend the US Constitution against foreign and domestic enemies. Obama is not a king. They take no oath to uphold Obama in office if he is found to be in violation of the US Constitution. Congress may go through the motions to impeach and convict Obama, but he would be less than a captain Duncell as he would not be president...because he never was.
While some Federal District Judge might issue a ruling, I don’t see the scenario where the Circuit Courts of Appeals or the Supreme Court will support the ruling. I think that they will declare this to be politics and refuse to act. I think that it was quite extraordinary that the Court agreed to take on Bush v. Gore. I’m certainly glad that they did, but I don’t have much confidence that they would do it again.

Doesn’t the Constitution give the courts the power to decide “controversies”?? Political questions come with the territory.
First, the ruling by the Supreme Court that find Obama who failed to qualify as president, then 2nd, a federal judge issues his arrest warranted for Obama.

And/or Obama gets arrested by law enforcement. So who is going to stop them? Eric Holder? Nope, he derives his power through the Executive Branch. Obama and all his presidential appointments would have their federal powers stripped.

And how, exactly, in your theory does Obama become eligible? Saying a dog has five legs doesn’t make it so.
So?...Nearly 6 out of 10 Americans have serious doubts about his being born here or have doubts about his natural born status.
And.. This many Americans are “kooks”, “nutz”, and “fringe”? I'd say Obama has a public relations problem on his hands.
I'd also say that the Republican Party and our so-called yapping “conservative” media have a public relations problem for having IGNORED and done almost NOTHING about Obama’s eligibility. I hold them in even greater contempt that I do the Marxists. At least I knew the Marxists were snakes. I didn't expect Rush, Hannity, Beck, Ingram, Coulter, Levine and the rest to bite me.
He was accepted as eligible by each of the states when he was certified for inclusion on the ballot. This was ratified by the electors when they cast their ballot for him. The VPOTUS (Cheney) certified him as the winner of the electoral contest. The Congress accepted this result. He was sworn in by the Chief Justice of the U.S.
Not a single Constitutional Officer, elector, Member of Congress, or state election official challenged Obama’s eligibility even though the birth certificate issue was certainly known.
I’m sure that you don’t like the outcome of this little drama. I certainly don’t, and it clearly demonstrated that our political system is not serious about ensuring compliance with Constitutional eligibility requirements. But that’s where we are and until someone with standing can bring a challenge, that’s where it will remain. I don’t think that such a challenge can be made until the 2012 election cycle.
