The operative word is "if" from my above post.
If the Supreme Court found that Obama's presidency was unconstitutional, I bet there would be plenty of Federal judges who would issue a warrant for his arrest when presented with proof, and the laws that he violated or is in violation. The same proof that the Supreme Court found that Obama was not eligible to be president.
if that were to happen, I think that Obama would give a response very much like the one that Jackson made, Mr. Marshall has issued his decision, now let him enforce it. In other words, such a declaration would go nowhere, either because Obama would ignore it or a higher court would overturn it. So, we are back to the impeachment route.
You'd find many federal officers at that point who would honor their oath to protect and defend the US Constitution against foreign and domestic enemies. Obama is not a king. They take no oath to uphold Obama in office if he is found to be in violation of the US Constitution. Congress may go through the motions to impeach and convict Obama, but he would be less than a captain Duncell as he would not be president...because he never was.
While some Federal District Judge might issue a ruling, I don’t see the scenario where the Circuit Courts of Appeals or the Supreme Court will support the ruling. I think that they will declare this to be politics and refuse to act. I think that it was quite extraordinary that the Court agreed to take on Bush v. Gore. I’m certainly glad that they did, but I don’t have much confidence that they would do it again.
