Costco is pushing back hard against a proposed class-action lawsuit that accuses the retail giant of misleading shoppers about its popular $5 rotisserie chicken.
In a motion filed last week in the US District Court for the Southern District of California, the warehouse club asked the court to dismiss the case, which was brought in January by two California customers.
The plaintiffs claim Costco’s Kirkland Signature Seasoned Rotisserie Chicken contains carrageenan and sodium phosphate while still being marketed as having “no preservatives.”
According to the lawsuit, that labeling misleads consumers and violates Washington’s Consumer Protection Act, California’s Consumers Legal Remedies Act, and other California statutes.
Costco’s legal team fired back, arguing the case rests on a misunderstanding of how the ingredients are classified.
Attorney Charles Sipos, representing the company, called the false advertising allegations “fatally flawed,” saying the substances in question are not considered preservatives under US Food and Drug Administration regulations.
Instead, he said they are used as part of the chicken’s seasoning mix.
Carrageenan, derived from seaweed, is commonly used in processed foods as a thickener and stabilizer.
Sodium phosphate serves multiple functions in food production, including thickening, curing, leavening, and emulsifying.
The lawsuit seeks to stop Costco from advertising the product as free of preservatives and to allow US customers who purchased the chicken to join a class action seeking monetary damages.

In class action lawsuits attorneys should be required to get permission from every client they want to represent. Finding two token clients and then saying you represent the other millions without any contact/permission is ridiculous.
Have been a participant in numerous class action lawsuits, never agreed to one of them.
As far as Costco chicken, I always try to find the smallest one because they can be undercooked near the center. I don’t eat the thing without cutting it up and cooking the big parts in the air fryer. I go to Costco all the time and don’t even buy the chicken even though it’s practically free at five bucks.

Thought I would add some more just for fun...
-Electronics - both very good - look for deals
-Furniture - Costco more expensive, better quality, Sam’s decent - so it depends
-Health and Beauty - depends on the items. Prefer Sam’s for our needs
-Protein supplements - Sam’s far superior
-Snacks - chips, nuts, cookies etc. - Don’t buy much of that but Sam’s superior for regular items of this type - Costco a little more eclectic.
-Prepared refrigerated “meals” -both have some very good ones - good variety if a member of both
-Frozen items - Sam’s club better for standard families, Costco more upscale - I’d choose Costco if I had to for this category.
-Tire service - Costco far superior
-Batteries - look for sales - both good.
-Car batteries - Both good
-Sports and recreation - both good
-Lawn care - Sam’s is better
-Grilling, fishing, hunting - Sam’s far better
-Office supplies - Sam’s better
Those are not necessarily used as preservatives.
(Carrageenan is just made of seaweed and used as a stabilizer; sodium phosphate is used as an emulsifier. These are used in many foods, but not necessarily as preservatives.)
I like the chicken our cat loves it and she says get stuffed ,LOL
and Costco’s rotisserie chicken seam to be bigger than chickens from other places
This is why we can’t have nice things. Somebody’s going to mess around and force Costco to either drop the rotisserie chicken completely, or boost the price three or four times higher.
The lawyer who filed this suit should be sanctioned, forced to pay all costs, and then be disbarred.

I can’t find where either is a preservative....
Costco has certain things that I won’t buy anywhere else. Butter. Bacon. I get the A2 milk. Whipped cream in the can. Romaine lettuce and cherry tomatoes and the little cucumbers. Blueberries. They have the little French rolls. Wild caught salmon. I like to buy a whole beef tenderloin and cut my own filet mignon steaks. Tri tip.
I always say that Costco brand products are always just a little bit crappy. Their alcohol products give me headaches so I will never buy a Kirkland Signature bottle of any kind of liquor. Their Keurig coffees are bitter. Their private label clothing.
However, I bought my last 3 major appliances from Costco. They deliver and install and take the old ones away and don’t have a separate charge for the services. Best Buy and Lowes slash Home Depot have a separate charge for installation and another for disposal of the old one. Even if the price is the same it’s still cheaper at Costco plus the membership rebate.
I get mine at Walmart along with my regular delivery. It is HOT when it gets dropped off and about 45 minutes out of the oven. Sooooo good...and gives me about 5 meals.
plaintiffs are after $$. That is all.
If components have a dual use, then yah can’t sue.
Did you see my comment about the cherry tomatoes being one of the things that is far better at Sam’s?
Another example that drives me crazy about Costco...Sun Maid Raisins are organic only! I get regular Sun Maid Raisins at Sam’s in the same quantity at half the price! I can’t stand the “organic” scam.
I love those dried cherries at Costco though.
I want to be clear, I am not putting down either club. I really like both and pay for the highest membership at both. I get almost everything from the two clubs. food, clothing, electronics, gas, furniture, appliances etc.
When you compare prices to other retail, you can save thousands per year.
A lot of people have to restrict their consumption of sodium. It’s unbelievably difficult.
Their organic extra virgin olive oil is good; it’s usually ranked highly by people who study olive oil as a quality, lower cost alternative.
This is one of the most tedious claims by phony “health influencers.”
As always loony left ruin a good thing, if they win they will sue Cosco because there is no chicken😎😂
