Apartment complex charges a woman $15,000 for breaking her lease. She had died.

The Lodge at Shavano Park apartments in San Antonio, Texas, wasn't about to let 91-year-old Sanda Bonilla out of her lease for some lame excuse like dying.

According to the apartment complex, Bonilla still owed them $14,368 in future rent, as well as another $1,117 for a lease break fee, and they sent the bill to the next of kin with a threat to send it to collections if they didn't cover her lease.

The bill even states the reason for breaking the lease as "deceased."

David Naterman, the woman's son, said,

We went to the apartment complex, spoke to the leasing manager and he told us that he would use the security deposit towards the cleaning and turning over the apartment and that they would terminate the lease.

The fact that they're attacking, coming after the next of kin, who, quite honestly, we loved our mom and we're still grieving, and all they care about is the money.

Bill Clanton, an attorney who specializes in consumer and debt collection, doesn't think the apartment complex has much of a case though.

I think it's pretty unusual. I've never heard of anybody trying to charge an estate or somebody who is deceased for rent before.

Texas Property Code (sec. 92.0162) says that a deceased person's estate can "avoid liability for future rent" with two steps: Remove all property from the abode and provide a written notice of termination. After the notice of death is received, the landlord can only charge up to 30 days' rent.

The landlord can charge for about 30 days once the lease is terminated. You can't get blood from a turnip, and you certainly can't get rent from a dead person.

The family is waiting to see if the apartment complex will follow through with its threats to send them to collections or file legal actions.

The quality of people in management these days is just awful. Unreasonable, unpleasant people who manage through fear.

A lot of workers are saying “Screw it” because the employer doesn’t care about the employee or the customer. Honor has left the workplace.

So, has the executor of the estate cleaned out the Apartment?

Just a guess, that the property owners are not originally from Texas, or any of the states. They don’t feel much of a connection with their tenants.

Victims of the philosophy that anyone can do anything so long as they have manager-bosses to teach them the job. But when managers are hired based on the same premise, the system fails!

I was going to ask what the terms of the lease were and what was the law. The article answered that, this the author appears to have committed real journalism instead of just outrage building click bait. Bad author! Bad author!

Company Policy on Death While at Work

INTEROFFICE MEMORANDUM

To: All Personnel
From: The Management
Date: April 1, 1985
Subject: Standard Procedure on Death of an Employee

It has been brought to the attention of the management of this company that
many employees have been dying while on duty for no good reason. Furthermore,
it also appears that some employees are refusing to fall over after they have
died. This, in some cases, has resulted in unearned overtime payments which are
not provided for under our employee benefit program.

Effective immediately, this practice must be discontinued!

On and after today, any employee found sitting up after he/she has died will be
dropped from the payroll at once, without further investigation. This action is
covered by Company Regulation #20 (non-productive labor).

When it can be proven that the employee is being held up by a desk, typewriter,
drawing board, telephone, or any other means of support which is the property
of the company, a one (1) day period of grace will be granted.

In the event of apparent death, the following procedures will be strictly
adhered to:

1. If, after several hours, it is noted that any employee has not moved or
opened at least one eye, the department head will investigate. Because of
the highly sensitive nature and/or origin of some employees and because of
the close resemblance between death and their normal working attitude, the
investigation will be made quietly so as to avoid waking the employee if
he/she is asleep (which is, of course, permitted under present union
contracts).
2. If some doubt still exists as to the true condition of the employee, a
pay check will be used as the final test. If the employee fails to reach
for the check, it is reasonable to assume that death has occurred. Note
that in some cases the instinct is so strongly developed that a spastic
clutching may occur even after death; do not be misled by this
manifestation.
3. In the event that an employee fails to abandon whatever he/she is doing
at coffee break time, no investigation is necessary as this is conclusive
proof that rigor mortise has already set in.

As a small landlord, I hear the horror stories of people who pass away and leave all their belongings, in many cases hoarding conditions, whilst the surviving relatives can’t be contacted or have no interest in clearing out the property for MONTHS.

If you are not running your rentals as a business investment, you will be paved under. Not to say this action was correct in this case but there are two sides to every story and the media LOVES to play up the eeeeeeevvvvviiiiiiil landlord, which more than likely is Big Apartment or Government Housing, and the poooooooor, opressssssssssssed tenant.
