(Aug. 7, 2024) — INTRODUCTION
As long-time P&E readers know, your humble servant has for many years railed on about the “natural born Citizen” (“nbC”) issue and how it has been handled (and mishandled) by commentators, scholars and governmental agencies such as the Congressional Research Service (“CRS”). But now, in mid-2024, with the issue again presenting itself in the form of the candidacy for president of one Kamala Devi Harris, and opposed to a tedious repeat of past posts, a brief “one-stop-shopper’s” refresher course, gathering and summarizing in one post the highlights of the debate, may be helpful for those upcoming weekend cocktail party gatherings and barbecue cook-outs where competing “discussions” (aka, “arguments”) on the topic may break out.
Your servant has on several occasions directly addressed the nbC issue as to Harris, here, here and here. The details of those posts will not be re-hashed here, but their conclusions remain: Kamala Devi Harris is likely constitutionally ineligible to seek the presidency, as she is very likely not a natural born Citizen as contemplated by the Founders and Framers of the Constitution.
Instead, your servant now offers the following highlights, summarizing how we got to this precarious juncture in the history of the Republic in the first place and in addition, what might be done to correct the situation, provided that there are enough patriots to put their collective shoulders to the wheel. Candidly, that goal presently seems remote, yet the only way to ensure failure is to forego the attempt. So, here goes.

So, under your “logic“ if somebody gets away with robbing a bank, we can’t charge the next person who robs the bank and gets caught with a crime, simply because the first guy got away with it. That is logically and legally absurd.
This discussion needs to be had right now, before the election, and preferably in a case before the United States Supreme Court. You can bet your bottom dollar that we are going to have more and more people with divided loyalties being put forth as candidates for President as time goes on. This is unacceptable. The intent behind the “natural born citizen” requirement in the Constitution is that the President of the United States not have any possibility of divided loyalties, and this was assumed (as the article mentioned) to be the case only with people who were both born as citizens, and who were ALSO born to two parents who were citizens at the time of their birth. Otherwise, there is no point to the words “natural born “ in the eligibility section of Article 2. From a legal standpoint, it has long since been part of our law that no words in the Constitution are there for no reason. They all have meaning, and we have never had a ruling on this particular issue during our entire history. We desperately need to have such a ruling, and better with the present Originalist-oriented composition of the Court than if the Democrats retain the presidency And we get a bunch of “Living Constitution” advocates.
I do not remember the Supreme Court, or any court ruling that Kamala is in fact eligible to be considered for president.

The courts will never rule that Kamala Harris or anyone else with the same citizenship status isn’t natural-born.
Focusing on that silliness is a distraction.

FR: Never Accept the Premise of Your Opponent’s Argument
The so-called Natural Born Citizen Conundrum may be deliberate smoke and mirrors.
More specifically, I looked for all references to John Jay, the first Chief Justice of the Supreme Court, in the referenced article, but could not find the excerpt below from his writings. It appears to be a short list of categories of official United States laws, Jay including the Law of Nations in the list.
