Trump signs massive COVID relief bill, invokes Impoundment Control Act of 1974

FYI Budget Update

-President Trump just invoked the Impoundment Control Act of 1974 while signing the COVID bill, allowing him to redline areas that must be addressed.

-This sends it back to Congress forcing them to 1) repeal 230, 2) cut out the wasteful spending, 3) add $2k.

FYI BU 2

-This is a virtually unknown law and has taken Congress by surprise.

-It also signals his intent to invoke *other* laws in the coming weeks.

Stay tuned.

-PER FOX: The Senate will start the process that increases checks to $2k, repeals Section 230, starts an investigation into voter fraud, per President Trump's redlines under the Impoundment Control Act of 1974 (which Nixon signed).

You can’t be serious?

He used an obscure law to red line certain areas of the bill.

This sends it back to Congress forcing them to 1) repeal 230, 2) cut out the wasteful spending, 3) add $2k and start an investigation into voter fraud. Those are the apparent highlights, there is quite likely much more red lined.

So in your mind you think cutting wasteful spending, repealing 230 and forcing an investigation into voter fraud is losing?

Go back to your shrink, he’s got you on some real bad meds.

What’s the use of utilizing Impoundment if Congress can just ignore?

I believe you are correct. I see no Constitutional mechanism that bypasses the legislative process and grants POTUS any such authority.

If a bill is passed by both houses of Congress and submitted to POTUS, he can either sign it in to law or not. Nothing inbetween...and Congress cannot modify that process without a Constitutional amendment.

My guess is he got something in return, maybe votes on repeal of section 230, etc. We will have to see.

I can understand being disappointed with this pork filled monstrosity. DC sucks.

Well, that means any assumption that he just caved in outright is probably false. If he caved in completely, DC would be breaking out the champagne and caviar.

The Dem chair of the Appropriations committee just confirmed this and said they will allow Biden/Harris to proceed.

I can understand people being disappointed but please do not feed the sleeper/troll who just popped up!

Why, yes; yes, as a matter of fact, it does begin October 1st.

This move telegraphs the President’s confidence he’ll be getting sworn in, again, on January 20th.

Otherwise all this does is kick the can down the road three weeks when Biteme will make it moot.

It doesn’t force Congress to do anything; it invites them to. But the current Congress ends in 6 days.

Also: the new Congress is even more strongly R, even if the Ds have a few seats majority in the House.

If there are do-overs or set-asides in the election, anyone know how that affects House seats for the next Congress?

it says Congress has 45 days, but I’m not sure if it matters if it’s a new or old congress. Sitting congress ends in 6 days, but the fiscal year doesn’t end until Oct 1.

Here’s a Gramm-Rudman-Hollings Act quote that speaks to the Executive Branch power, and specifically of the Comptroller General’s office, which works to Trump’s advantage,

Synar, (478 U.S. 714 (1986)) as an unconstitutional usurpation of executive power by Congress because the Comptroller General’s function under the Act is the “very essence” of execution of the laws, which is beyond the power of a legislative body. It was noted: “Once Congress passes legislation, it can influence only its execution by passing new laws or through impeachment.”
