Pritzker signs legislation expanding vote-by-mail for 2020 election

PEORIA, Ill. (WMBD) – Gov. Pritkzer signed Senate Bill 1863 and House Bill 2238 into law today, expanding residents abilities to vote by mail (VBM) for the 2020 general election.
The legislation gives all recent voters VBM applications and intends to promote safe civic participation in the election while COVID-19 persists. The legislation also makes election day a state holiday and expands voting hours at permanent polling places. Lastly, it improves the signature verification process to ensure election integrity.
“In the face of a pandemic, massive economic upheaval, and renewed calls for racial justice, it’s more important than ever that Illinoisans can hold accountable a truly representative and transparent government – and that means ensuring all eligible residents can wield their right to vote in a way that doesn’t risk their personal health,” said Pritzker. “Sending vote by mail applications to residents who have participated in recent elections will allow more people to exercise that right from the safety of their own homes and help reduce the spread of COVID-19 in our communities.”
Illinois State Board of Elections are now required by law to:
Post an application for a vote by mail ballot on its website;
Modify the online voter registration system to allow a new registrant to apply for a VBM ballot when completing the online registration;
Provide notice to each election authority about what it must do to comply with the new law and;
Adopt emergency rules to provide reimbursement for expenses related to the 2020 general election incurred as a result of COVID-19 and the new requirements.
Local election offices are now required to mail or email VBM ballot applications alongside the VBM timeline to voters who cast a ballot in the last two general elections, including those who changed addresses or registered after the primary election. Voters can receive their VBM ballot within 5 business days.
The legislation also made it more difficult to reject a VBM ballot. A bipartisan panel of three election judges must be appointed to verify signatures and ballot validity.
Permanent branch polling places are mandated to be open from 8:30 a.m. to 7 p.m. on weekdays and from 9 a.m. to 5 p.m. on weekends and holidays. Curb-side voting is permitted so that voters may fill out their ballot outside of the polling place. The bill also helps voters whom COVID-19 presents increased health risks by authorizing election authorities to establish additional early voting hours.
Sen. Julie Morrison (D-Deerfield) sponsors the legislation. She said those who are eligible to vote should be able to do so safety and securely.
“No one should have to worry about jeopardizing their health to practice their civil duty,” Morrison said. “It is vital that no eligible voter — regardless of age or health — end up disenfranchised by the current health crisis. More voters will be able to participate in a very important aspect of their citizenry — their right to vote — because we have a plan in place to allow them to do so safely. We must be prepared, because we don’t know how safe it will be for people to be this fall.”
Rep. Kelly Burke (D-Evergreen Park) is another sponsor of the legislation who fought for the legislation during the special session in May. She says VBM precautions are necessary for the 2020 general election.
“The COVID 19 pandemic has created many challenges, but participation in the November election should not be one of them,” Burke said. “Just as we have taken precautions to make shopping, traveling, and other everyday tasks safer, we must also take precautions and make adjustments to ensure everyone can safely exercise their right to vote.”
The laws go into place effective immediately.
WHAT TEXAS WANTS:
WHEREFORE, Plaintiff States respectfully request that this Court issue the following relief:
A.Declare that Defendant States Pennsylvania, Georgia, Michigan, and Wisconsin administered the 2020 presidential election in violation of the Electors Clause and the Fourteenth Amendment of the U.S. Constitution.
B.Declare that any electoral college votes cast by such presidential electors appointed in Defendant States Pennsylvania, Georgia, Michigan, and Wisconsin are in violation of the Electors Clause and the Fourteenth Amendment of the U.S. Constitution and cannot be counted.
C.Enjoin Defendant States’ use of the 2020 election results for the Office of President to appoint presidential electors to the Electoral College.
D.Enjoin Defendant States’ use of the 2020 election results for the Office of President to appoint presidential electors to the Electoral College and authorize, pursuant to the Court’s remedial authority, the Defendant States to conduct a special election to appoint presidential electors.
E.If any of Defendant States have already appointed presidential electors to the Electoral College using the 2020 election results, direct such States’ legislatures, pursuant to 3 U.S.C. § 2 and U.S.CONST.art. II, § 1, cl. 2, to appoint a new set of presidential electors in a manner that does not violate the Electors Clause and the Fourteenth Amendment, or to appoint no presidential electors at all.
F.Enjoin the Defendant States from certifying presidential electors or otherwise meeting for purposes of the electoral college pursuant to 3 U.S.C. § 5, 3 U.S.C. § 7, or applicable law pending further order of this Court.
G.Award costs to Plaintiff State.
H.Grant such other relief as the Court deems just and proper.

MOTION FOR PRELIMINARY
INJUNCTION:
This Court should first administratively stay or temporarily restrain the Defendant States from voting in the electoral college until further order of this Court and then issue a preliminary injunction or stay against their doing so until the conclusion of this case on the merits. Alternatively, the Court should reach the merits, vacate the Defendant States’ elector certifications from the unconstitutional 2020election results,and remand to the Defendant States’ legislatures pursuant to 3 U.S.C. § 2to appoint electors.

Guess I’m pretty obssesd. Here’s what I can find quickly. I won’t put dates, the first one quotes some perfesser feller, but I need more authoritative sources so I’ll see what pops up. I had to check out about 12 or more articles; most just discuss the niceties of invoking it or history.

Before invoking the powers under the Act, 10 U.S.C. § 254 requires the President to first publish a proclamation ordering the insurgents to disperse. As part of the Posse Comitatus Act of 1878, these provisions are now codified as amended.
There are Constitutional exceptions to Posse Comitatus restrictions rooted in the President’s own constitutional authority. Defense Department guidelines describe “homeland defense” as a “constitutional exception” to Posse Comitatus restriction, meaning that measures necessary to guarantee National Security from external threats are not subject to the same limitations.

Sec. 331.
Federal aid for State governments
Whenever there is an insurrections in any State against its government, the President
may, upon the request of its legislature or of its governor if the legislature cannot be
convened, call into Federal service such of the militia of the other States, in the number
requested by that State, and use such of the armed forces, as he considers necessary to
suppress the insurrection.
Sec. 332.
Use of militia and armed forces to enforce Federal authority
Whenever the President considers that unlawful obstructions, combinations, or
assemblages, or rebellion against the authority of the United States, make it impracticable
to enforce the laws of the United States in any State by the ordinary course of judicial
proceedings, he may call into Federal service such of the militia of any State, and use
such of the armed forces, as he considers necessary to enforce those laws or to suppress

Sec. 333.
Interference with State and Federal law

within the State, that any part or class of its people is deprived of a right, privilege,
immunity, or protection named in the Constitution and secured by law, and the
constituted authorities of that State are unable, fail, or refuse to protect that right,

(2) opposes or obstructs the execution of the laws of the United States or impedes
the course of justice under those laws.
In any situation covered by clause (1), the State shall be considered to have denied the

Whenever the President considers it necessary to use the militia or the armed forces under
this chapter, he shall, by proclamation, immediately order the insurgents or those
obstructing the enforcement of the laws to disperse and retire peaceably to their abodes

The government moved to dismiss the case by rule 48(a) ECF NO. 198.

That was REJECTED, because the case against Flynn was MOOT (vernacular, as in "it's a moot point" meaning no longer viable or in question), due to the Pardon.
The government moved for a consent motion to dismiss the case as moot ECF #308 (I guess the govt. filed a consent motion to dismiss the case due to the pardon).
That was GRANTED.
The case itself, is dismissed as MOOT, due to the Pardon.
Just tying up loose ends and clearing up paperwork.
