California Poised To Ban Hairstyle Discrimination

This is California, remember. The Golden state is perched to become the first in the nation to ban discrimination based on unique hairstyles, mainly targeting blacks.

The measure, which has passed both chambers of the state legislature, could be signed by Gov. Gavin Newsom as soon as next week.

It’s aimed at schools and workplaces where blacks say they have been pressured to abandon hairstyles traditionally a part of their culture and have been denied jobs and advancement when they did not adopt more Eurocentric styles of personal grooming.

The bill, if signed, would prohibit enforcement of personal grooming policies affecting disproportionately those of color, especially blacks. This includes prohibitions on certain hairstyles, such as braids, twists, Afros, cornrows and dreadlocks.

I wonder how the law defines "grooming". Webster's dictionary defines the base word groom "to make neat or attractive". So does that mean if a group can claim dressing like a slob is part of that group's culture than employers cannot enforce a dress code? Many black males like to wear their pants low exposing their underwear, is that now "protected"?

Having sat in a big company board room I can say that the first consideration is always, “what is our liability?” The more “rights” the government gives a group, the fewer of that group wins employment. The risk of hiring them is too high. We saw this with the plunge in disabled employment right after ADA passed.

I wonder how this will clash with health department regulations for food service-type jobs. I also expect that the military and law enforcement are not going to be too keen on just any old hairstyle.
