Federal court halts Trump’s immigration ban

The federal court for the Eastern District of New York issued an emergency stay halting President Donald Trump’s executive order banning entry to the US from seven majority-Muslim countries tonight, following widespread protests at airports around the country.

The court ruled on a habeas corpus petition filed by the ACLU on behalf of Hameed Khalid Darweesh and Sameer Abdulkhaleq Alshawi, who were denied entry to the US upon landing at JFK airport in New York City and detained indefinitely by Customs and Border Patrol. Darweesh spent a decade working for the United States military in Iraq as an interpreter and engineer and had been granted an entry visa after background checks; Alshawi had been granted a visa in order to join his wife and son who are already permanent residents of the US after their similar service with the US military.

There should be exceptions on a case by case basis. This is about getting. That’s what Trump himself said. It appears that two Iraqis either assisted the US military over a long term, or their spouse did. Seem like decent vetting. They could face actual retribution for that in Iraq.

It looks like this only pertains to the 100-200 refugees/visa holders that were in transit/at the airport when the order went down. This is liberal judicial activism. The order is legally sound.

It should have no effect on anyone else. Obama banned Iraq refugees in 2011 and Carter banned all Iranian nationals and expelled them from US in 1979.

I don't think it's the whole ban, but this is confusing:

The court specifically ruled on Darweesh and Alshawi’s petition; the ACLU will have to include all other similarly-affected immigrants as part of a class action to have it apply more broadly. But the point of a stay is to preserve the status quo while a permanent ruling is made — something the judge specifically reminded the lawyers for the goverment in the courtroom. And as the tweet from the National Immigration Law Center’s Jackie Vimo indicates above, there is a likelihood of class certification.

I didn’t read the entire EO but I think some of this confusion comes from the agencies directions. On purpose? And these two guys had lawyers on hand so it was planned. I would think if someone already had a green card or some extenuating circumstances there was a clause in the EO for them already. If this country has come down to liberal judges taking away a president’s constitutional rights then it’s time for further action. I’m sure Trump thinks the same way.

We’ve had an out of control federal judiciary for a very long time.

Perhaps it’s time to greatly reduce the scope of their power.

If you and I have a problem with the feds, it takes literally years to get the issue addressed, and after we’re bankrupt, we may not even prevail. In fact, most times we won’t.

So these bastards that aren’t even citizens have a beef, and it’s addressed in 24 hours.

You now folks, we have some judges that need to be retired.

The court action only applies to the two Iraqi citizens. Not to the Trumps EO.

The stay is temporary and a court will have to decide whether to make it permanent at a later date—and it only affects people who have already arrived in the United States or are currently in transit

N o the ban is not halted. The deportation of two illegal aliens is being stayed pending a full hearing between the AG and the ACLU.

The ban is still in full effect.
