Hey, Texplainer: Britain voted to leave the European Union. Can Texas secede from the United States?
In the wake of Britains historic vote to leave the European Union - nicknamed "Brexit" - speculation of a Texit on the horizon have cropped up once again. The secessionist movement has a long history in the Lone Star state. Delegates for the Texas Republican Party even recently debated adding secessionist language to the party's platform. But is it actually legal for Texas to leave the United States?
Simply put, the answer is no. Historical and legal precedents make it clear that Texas could not pull off a Texit - at least not legally.

I think it would be bigger than that, even if it didn’t come to shooting.
The biggest issue would be that Texas would unable to issue any money since the US would warn the world that any country that accept Texas money would have its US assets frozen and probably dozens of other nasty economic sanctions. The US would probably then take its posts and bases back and not allow Texas to sell nor move its oil via blockade and the like.
But it would be a very interesting foray into speculative projection to lay out step by step what would happen if Texas DID decide to leave. Might make an interesting book if someone hasn’t already written one.

Too true, and the same reaction would repeat today, if Texans came to to the realization that no amount of negotiating, or ‘working within the system’ was effectively answering or alleviating their grievances.
It all depends upon how far The People are pushed by the national government.
Personally, I feel that if Trump is elected, much that agrieves us will be alleviated. If not, then all bets are off.
The states entered the union voluntarily. There’s no reason they shouldn’t be able to leave voluntarily. What they don’t have the right to do is wage war against the union. And why would Texas want when the statists and globalists are on the way out?
The Republic of Texas “won in battle” their freedom from MX. Then they negotiated entry into the United States.
Freedom is never negotiated, it is always won in battle.

Because that isn’t what they signed up for. When they became a State, they became a State forever. Voluntarily.
Texas has already repatriated it’s gold reserve. And is in the process to building a depository for precious metals.
Is that a first step? You can answer that question yourself.

Texas, or any state for that matter, can secede from the United States. Each state is sovereign and the federal government derives its powers from the states. Therefore, any state can decide, at any time and for any reason, to rescind the power that it has lent to the federal government and reclaim it for it own use.
If it’s true, and if they do secede, that will be my plan b for SHTF - I’ll go find Marcella. LOL
A popular Texas myth, but a myth nonetheless. All of the statehood acts are easily found online and no such language can be found. What CAN happen is that Texas can exit the Union the same way it entered, via a bill passed by both houses of Congress and signed by the President. I'd start by electing state representatives who will vote to submit it as a ballot resolution. So far, though, I don't think anyone anywhere has won election on a secession platform since, oh, 1860.
So many here on FR have no concept of what California is really like. Most of the state is rural and conservative with vastly different topography and environments from sea shore to farmland to high deserts to 14,000' mountains (the highest outside of Alaska). Unfortunately, the big cities along the coast have the highest populations and they decide the politics of the state. Many of those are Liberals who migrated here in the last 40 years from back east and ruined our state.
Thank you for recognizing my point. Sometimes freedom is indeed negotiated.

Well, if things keep on going the way they are going, it might become a pretty popular platform somewhere down the line.
They were already free, never had to “negotiate” freedom when they entered the US.

Not true. The contract creating our federal government has been grossly violated, which gives justification for voiding that contract. More practically, if the oppressor permits you to leave or if you win in a revolutionary/civil war (as we did in the American Revolution), secession was legal. If you fight and lose (as the South did), rebellion was treason. Given the sissy currently occupying our White House, it is likely that Texas could have seceded without opposition, which would have made it legal. If the witch wins in November, it's time for Texas to find out if secession is legal.

The question that led the thread was: Can Texas LEGALLY secede from the U.S.
The answer is No. Unqualified, unquestionably, no. There isn’t even a mechanism to do so. But if Texas were to somehow “apply” for Secession, the answer would be No (starting at Texas v. White op. cit. and probably going on for hundreds of pages).
Now the question SHOULD Texas be able to secede and, if so, HOW would it secede is interesting, if masturbatory.
As I noted above, Texas would be unable to move its oil so it would have few if any resources available. That is just off the top of my head.
If they can govern themselves, why not?
Well, St. Louis City and St. Louis County got divorced years ago. So it is not unheard of.
The Northern States could not allow the Southern States to leave the Union because the Southern States had a lawful claim to all the lands west of the 13 original colonies and would have claimed them.
