Columbia? Taken. Mississippi? Taken. Sacramento? El Niño? Marlin? Grizzly? Sorry, they're all taken.
Virtually every large city, notable landscape feature, creature and weather pattern of North America as well as myriad other words, concepts and images has been snapped up and trademarked as the name of either a brewery or a beer. For newcomers to the increasingly crowded industry of more than 3,000 breweries, finding names for beers, or even themselves, is increasingly hard to do without risking a legal fight.
Candace Moon, aka The Craft Beer Attorney, is a San Diego lawyer who specializes in helping brewers trademark ideas and also settle disputes. Moon tells The Salt she has never seen a brewery intentionally infringe upon another's trademarked name, image or font style. Yet, with tens of thousands of brands in the American beer market, it happens all the time.
"There are only so many words and names that make sense with beer, so it's not surprising that many people will come up with the same ideas," Moon says.

Moose bit my sister beer
I’m in the shower beer
Hugh and Series beer
etc.
Whaddaya mean someone already has a trademark out on the name Olde Frothingslosh?!? But... but mine is a pale stale ale with the foam on the bottom!!!
Pittsburgh Brewing has about a bazillion brands. They all taste the same - incredibly bad.
At least Olde Frothingslosh is truthful in their advertising.
They could do like the pharmaceutical industry and just make up words from scratch. For instance,
Zortrephnofil Lager
Blexfornifam Stout
Trifleroflop IPA
Xumeritrol Ale
Etc.
Wonder which mi-spec this was brewed under.
“Just.beer.”
Expect a call from my lawyer!
‘Merica!!! ; D
On that note, there’s He’brew, The Chosen Beer.
Has Pretentious Asshat Swill been taken yet?
Ah, you beat me to it, and with a pic as well.
Gah! Quick...beer me!
Ah...the genius of their marketing technique becomes clear.
I bet npr runs out of articles before America runs out of names for beer. Too late! npr already ran out.
Thank you comrade, this beer I will very much look for on next trip to Peoples Co-op. We all must help to support the Party and buy glories products of USSA. Great leader wants workers happy and quiet as they get on bus.
Don’t forget ‘Stune My Beebeer’
Check with your local purveyor. They can order it. You'll never go back to Fat Tire/Dogfish Head/Arrogant Bastard or any of the other goofy named beers over here.
Now, if you're a hop head and prefer a good ale...then knock yourself out. I recommend Long Trail's Double Bag.
You’d be surprised how much work goes into finding names for drugs, but yes, they do sound pretty random sounding.
It’s called “ Banned Again”. He’s a mythic figure. I don’t know what became of him but I like to think he’s living out on the fringes somewhere, maybe flipping burgers in Arizona or selling curios in Morocco.
When I was in college, there was restaurant located adjacent to campus called, “The Lamp Post” (an allusion to CS Lewis’s Chronicles of Narnia). I don’t recall the specific details of the college’s acquisition, but seem to remember it had been purchased by an alum who gifted it to the college. The college turned it into upper-class student apartments where I resided my senior year. A class mate of mine and I endeavored to brew our own ale, which we dubbed, “Lamp Post Ale.” As an art major, I even availed myself of the opportunity to use one of my classes to design and produce the bottle labels...still think I have one of them around here somewhere almost 25 years later :-)
