Obama isn’t eligible to be President

We already know that Obama is not QUALIFIED to be the President, we now know that he is not ELIGIBLE to be President under American law.

This is a great comment to a post over at Michelle Malkin’s blog:

His mother would have needed to have been 16+5= 21 years old, at the time of Barack Obama’s birth for him to have been a natural-born citizen. As aformentioned, she was a young college student at the time and was not. Barack Obama was already 3 years old at that time his mother would have needed to have waited to have him as the only U.S. Cizen parent. Obama instead should have been naturalized, but even then, that would still disqualify him from holding the office.

*** Naturalized citizens are ineligible to hold the office of President. *** Though Barack Obama was sent back to Hawaii at age 10, all the other info does not matter because his mother is the one who needed to have been a U.S. Citzen for 10 years prior to his birth on August 4, 1961, with 5 of those years being after age 16. Further, Obama may have had to have remained in the country for some time to protect any citizenship he would have had, rather than living in Indonesia. Now you can see why Obama’s aides stopped his speech about how we technically have more than 50 states, because it would have led to this discovery. This is very clear cut and a blaring violation of U.S. Election law. I think the Gov. Of California would be very insterested in knowing this if Obama were elected President without being a natural-born U.S. Citizen, and it would set precedence. Stay tuned to your TV sets because I suspect some of this information will be leaking through over the next several days…

Irrelevent. He is a natural born U.S. citizen due to the fact that he was born in the United States to a citizen.

Don't have to go to the age of the mother factor, it's done.

Before 1959, Hawaii was an organized territory of the United States, so if Obama was born there, he's an American citizen.

No it didn’t.

The law that is quoted is in reference to a person born outside the U.S. to one parent that was a citizen and a parent that is not a citizen.

If you were born in the U.S. to a citizen, this point of the law didn’t come into question.

Because this condition covers the cases were the candidate is born, outside the US, to an naturalized citizen, who has to have resided in the US for 10 years after naturalization (5 after she turned 16)

1. Obama's mother was a natural born citizen so this doesn't apply

2. Even if it did, Obama was born in the US, so it doesn't apply, double.

That statute is irrelevant to his situation as we know it.

Hawaii, even as a territory, has been regarded as part of the United States as an incorporated organized territory. People who are born in incorporated organized territories are American citizens. Period.

Are you sure he was born in Hawaii?

Internets are saying his mom was not allowed to fly because of her pregnancy. She may have given birth in Kenya and then flew to Hawaii. She then applied for a birth certificate.

I know the the tin foil hat is on, but, it is out there.

Let him prove these rumors false.

So a child born on American soil to a native-born (indeed 10th generation, or something like that) American woman is not an American citizen unless she is at least 21 years old?

The problem is, as I stated, that he was apparently born in Hawaii while Hawaii was a state, something that appears to trump everything else and make him a natural born citizen under the same SCOTUS precedent that makes children of illegal aliens who are merely born in the U.S. natural born U.S. citizens. The way this rule is written, it appears to apply to children of U.S. citizens who are born outside of the U.S. Again, my question is, "How do we challenge his eligibility to run for POTUS, given the act that he was apparently born in the U.S.?"

Maybe you should check the law. The law, even before 1986, works along a pathway.

First, were you born in the U.S. to parents who did not have diplomatic immunity? If yes, you are a natural born U.S. citizen.

Second, were you born outside the U.S. to parents that were both U.S. citizens? If yes, you are a natural born U.S. citizen.

Third, were you born outside the U.S. to a parent that was a natural born U.S. citizen and to a parent that was a not a citizen? If yes, you are a natural born U.S. citizen.

Fourth, were you born outside the U.S. to a parent that was a naturalized U.S. citizen that had lived 10 years in the U.S. including five years past the age of 16 and to a parent that was not a citizen? If yes, you are a natural born U.S. citizen.

Since Obama qualified under the first check point, the rest is irrelevant.

Even if the “flight from Kenya” story is true, he was still born to a natural born U.S. citizen.

But seriously, was she thinking when he was born that he might one day run for President so she plotted to not get a birth certificate until she got to Hawaii?

That is the type of conspiracy nonsense you would have to buy into.

If that's true, then there is no problem and all this tin-foil stuff is a waste of effort.

But, without access the his birth certificate, that KEY ASSUMPTION that he truly was born in Hawaii is not proven. If that piece turns out wrong, then the tin-foil stuff may have validity.

This topic doesn't truly go away until we see the birth certificate.

Except that the 'opinion' seems to be built on BS. The applicable statute is Section 301 of 8 USC 1401:

The following shall be nationals and citizens of the United States at birth:

(g) a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than five years, at least two of which were after attaining the age of fourteen years.

Two years, not five. After age 14, not 16. Even if he wasn't born in Hawaii, Obama is a natural born U.S. citizen under the Constitution and the laws of the United States.
