Cab driver in lacrosse case acquitted (DukeLax cabbie escapes Nifongery)

The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.

Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations.

After authorities learned of Elmostafa's potential role in the rape case, they found an unserved warrant naming him in a 2003 shoplifting case at a Hecht’s department store at Northgate Mall in Durham. A security officer for the store testified today in district court that he saw a woman steal handbags from the store and then jump into Elmostafa’s cab, which sped away.

The security officer testified that the cab pulled away even before the woman had closed to the door. A store surveillance tape, played in court, appeared to show that the door closed first.

Defense lawyers in the lacrosse rape case have said that Elmostafa was charged because he is a favorable witness to the defense. Loflin put one of the lacrosse investigators on the witness stand this morning and produced typed notes from the lacrosse case that show District Attorney Mike Nifong wanted to be informed when Elmostafa was arrested.

Assistant District Attorney Ashley Cannon told the judge the shoplifting case has nothing to do with the rape case.

Where are the favorite teachers of the lacrosse players?

Do they too feel their foremost duty as teachers--or even as human beings--is to keep quiet when their students are being lynched?

Even if they have to resign in order to speak out--then why don't they resign?

The whole Duke faculty are acting like "good Germans"--not a part of the Holocaust, but simply minding their own business and seeing nothing, and pretending that since they aren't directly involved, they have no responsibility and are innocent of everything.

What a grand legacy and example to leave for future generations of Dukies--NOT!

They detectives in the courtroom, and there may have been more, were not all there because of a defense subpoena - or because they served an old warrant.

The Defense lawyer said twice in court (maybe closing argument) - Why are they here? Why are they here today, if this has nothing to do with Duke case. So, if Himan was in fact there for a legitimate reason, then there was two others.
I suspect Linwood Wilson was there. I don't think there was any legitimate reason for Clayton or Wilson to be there.

Himan did record in his notes (and ONLY him) that Nifong wanted Elmostafa arrested and wanted to be alerted when he was in Police custoday.

Somebody may have already mentioned this, if so, sorry.

CTV is out of control ! They recruited a bunch of Haters and it's not a discussion. There's absolutely no give and take. I wonder why the moderator other there allows so many disruptors from one side that obviously don't want a discussion. CTV has gone down the Crapper.



On another note, a couple days back, a woman on Talkleft said that if the woman was raped OR IF SHE IS A FALSE ACCUSER - she has her interests at heart. She said she is staying involved in the case to see that the woman doesn't get treated poorly by the press or courts. I guess it's a RIGHT now to falsely accuse someone. OUTRAGEOUS !
I can't recall another another case where so many are admitting - even if she made it all up - like Jesse Jackson stated.

That's the only reason why this case is still breathing - because there are so many that hate the players and what they represent. More than a few are in the Media too.

Police or Sheriff's that serve warrants don't go to court. Elmostafa claimed 3 detectives were there when he was arrested. Process servers - Sheriff's are needed in court. That's almost an administrative function. Does the woman that fingerprinted him have to be in court. The jailer that accepted his bail - does he have to be there?

Clayton had not one thing to do with the original incident at the mall.

I gave up trying to read the CTV boards. Too many disrupters.

The inmates are running the asylum over there. Coldwater and the Nifong lynch mob over there have drove off so many sane posters that the place is clearly a joke. I can't believe that they are bothering posting garbage in the Elmostafa thread. Those people need some help. I don't think I am going to bother reading anything over there anymore either unless some people here call attention to something over there.

I was over at CTV before I sign up over here even. They have banned so many defenders of the players, yet they let the Disruptors and Hater run amok. I know of at least 5 reasonable posters that were banned - and I think Jezebelle was banned over there too, if I'm not mistaken.

It's not worth it over there. There are not reasoned responses from the other side - there's only childish BS responses. The place has been hijacked.

Fabulous Points! Ruth Sheehan is despicable.

I didn't always feel like that, but after watching her and her fellow Fatcats, Barry Saunders, Dennis Rogers, etc. - just sit by and allow these injustices right here. They just chose to totally ignore it, when the complexion changed. Gottlieb, Blinco's, Elmostafa, Seligmann's alibi - no matter.

This speaks volumes to me about what type of people they are.

There were still some people who believed Tawana Brawley after the truth came out.

Ten years later, nobody does.

People don'tlike to admit errors. I don't expect very many of the AV's most ardent supporters to do 180s and admit anything; most likely they'll still support the AV's right to a decent life (and view her as a poor, wronged working mother), but shift the focus of their blame to the DA for either
1) using them for a false case; or
2) not producing enough evidence.

That way they can keep their self respect and not have to eat crow.

Ten years later, nobody will believe the AV or admit to having supported her.

If all this there is no grey to Nifong BS were true, then he would only be not fit to be a DA. It is a lie.

I don't for one second think there is no gray in Nifong's world. He hired Wilson to investigate murders and he ends up doing a warrant search on a cab driver over a 3 y/o spit on the sidewalk type of offense.

They have admitted to having over 60,000 unserved warrants... Do they really think the public is so dumb as to buy into the "Elmo prosecution had nothing to do with Duke 3" lie....??? Do we look dumb?

As several of us have said, the DEFENSE, that is Elmo's attorneys, likely subpeonaed them to be there. They were NOT likely there by their choice or at the Nifong's direction.

Yes, but here is where the pot-bangers get hoist by their own petard - now they are saying that DAs should strong;y test the veracity of a rape victim before bringing the case?

Just like with BJ Clinton - when their man was found guilty of rape - now we are supposed to throw the "women don't lie about rape" canard out the window.

Can't have it both ways.

Summary of Gretta's Nifong segment:

1. Begins with the two woman organizing to get student to vote in the DA election.

2. The two young woman say they have handed out a couple of hundred registration form and have 30 or so already.

3. Goal is to have 2000 Duke students registered.

4. Say they are not endorsing a candidate.

5. Gretta asks about what 2000 would mean in this primary. They point out that turnout may not be great.

6. Gretta asks if 2000 votes against Nifong would get rid of him.

7. Gretta asks if they know lacrosse players. They say yes, but they know lots of people.

8. Gretta ask what they think about Nifong's handling the case. One says they think he has been in error from the start.

Not much here but back on the cable circuit which is good.

I heard it on XM radio. In the context of the case, not much added but . . . there was always an apathy on the part of Duke students to get involved in Durham voting; most students who voted did do in their home states. That said, there are enough eligible potential student voters at Duke to make a difference in local elections. Good for them, hope they nail that sniveling, lying creep in an open democratic process.

The only downside I see is that Nifong will use this as a campaign theme, further whipping up anti-Duke sentiment (i.e. poor, poor me, those rich Dukies are trying to get me, don't let those rich yankees get away with it!) All of us who attended Duke always knew there was an anti-Duke sentiment in the community but did not understand hte depth of hatred until this happened. Nifong already demonstrated a willingness to deal the race card fromn the bottom of the deck, he will certainly be willing to make hte election Duke v. Durham.

Now that was good! They came across as very genuine and sincere. I had to chuckle when the one started to list what Nifong did wrong, then stopped herself and got back on message. You could tell she was ready let him have it.

They were there to get a message out to Duke students, and their appearance on Greta tonight did just that.
