Ready4Freddy,

Police or Sheriff's that serve warrants don't go to court. Elmostafa claimed 3 detectives were there when he was arrested. Process servers - Sheriff's are needed in court. That's almost an administrative function. Does the woman that fingerprinted him have to be in court. The jailer that accepted his bail - does he have to be there?

Clayton had not one thing to do with the original incident at the mall.

As several of us have said, the DEFENSE, that is Elmo's attorneys, likely subpeonaed them to be there. They were NOT likely there by their choice or at the Nifong's direction.

But Mike, since the defense introduced the theory that the arrest warrant was served in order to intimidate Elmo in the Duke case, the defense must show some evidence of that. The only way to do that was to have Himan testify to his notes and Clayton to what he asked Elmo just before he served the warrant.
